Research On Legal Issues Concerning Foreign Adoption

Currently,intercountry adoption is quite normal in the daily life.The legal conflicts on the intercountry adoption are fierce between two countries.Although the intercountry adoption has developed for decades,A lot of legal conflicts are still needed to be solved.Due to the historical and other reasons,the development of intercountry adoption of our country is behind other countries.The law is not suitable for the current situation.Some issues needs to be addressed in the future development of adoption law.This paper,after brief introduction of the adoption and intercountry adoption,finds some legal conflicts in the intercountry adoption,and review two principles of intercountry adoption.Then,analyze the uniformed substantive law and conflict of law in the intercountry adoption.Meanwhile,this paper has studied some special questions in the intercountry adoption.Finally,give some advices to the legislation of Chinese adoption law.In the first part,this paper introduces the concept and the history of adoption and intercountry adoption,finds the legal conflicts,explains the best interest of child principle and the attributive principle.The Second part and the third part discussed the uniformed substantive law and conflict of law in the intercountry adoption respectively.Part IV analyzes some special questions in the uniformed substantive law and conflict of law in the intercountry adoption.Last part analyzes the current law in China and give some suggestions on the legislation.
