Research On The Legal Issues Of Consumer Property Rights Protection Under The Prepayment Consumption Model

Prepaid consumption patterns have been developed in the retail and service consum ption for many years.It is very convenient,and has a win-win characteristics,there fore,operators and consumers all like it.The prepaid consumption pattern exposes many drawbacks while coverage and usage increasing.It will hurt the legitimate rig hts and interests of prepaid consumers particularly.Most consumers are afraid and t he most serious loss is litigation involves property damage.It proves China has sho rtage in legal protection of prepaid consumer property rights,legal protection syste m still need to improve.This article takes the property rights of the prepaid consu mers as the research object,tries to put forward some suggestions on the legal prot ection system of the property rights of the consumers,and to promote the prepaid consumption patterns in an orderly development in China's market economy.In addi tion to the introduction and conclusion,this paper is divided into five chapters:Chapter 1:Summary of prepaid consumption patterns.This chapter focuses on the concept of prepaid consumption patterns,the development of prepaid consumption p atterns,the characteristics of prepaid consumption patterns,the legal nature of prepa yments and prepaid consumption transactions.Chapter 2:Analyze the status quo of loss of property rights of prepaid consumers,this chapter details the specific types of property rights of prepaid consumer losses,listed the survey data and news reports related to the prepaid consumer property rig hts disputes,use the case cited to illustrate the prepaid consumer property rights of the common situation,to show the status quo of impaired consumer property rights.Chapter 3:Analysis of the reason why the property rights of prepaid consumers are easily infringed.In the prepaid consumption patterns,consumer property rights are easily infringed,because of the following reasons:prepaid card issuance supervision is weak,prepaid consumer's right to know is difficult to achieve,lack of formal c onsumer contract text,and after the bankruptcy of the firm,the consumer reaches t he order of compensation in the back.Chapter 4:Reference to the relevant legal systems in the United States,Japan and Taiwan.This chapter analyzes the legislation and practice of prepaid consumption p attems legal regulation and consumer property protection in the United States,Japan and Taiwan,want to learn from,to improve the prepaid consumption property leg al protection system in China.Chapter 5:suggestions on perfecting the legal protection system of prepaid consume r property rights.This chapter proposes to improve the system of property rights pr otection for prepaid consumption in China by:strengthen the supervision and manag ement of prepaid card issuance,improve the prepaid card issuance record,prepaid c apital custody and use management system,guarantee and save the consumer right to know,formulate and implement a model of prepaid transaction contract,set up a deposit system for prepaid funds,return the unspent balance to the consumer,enco urage operators in the same industry to sign a performance agreement.
