Prepaid consumption is a new consumption pattern that the consumer needs to payfirst before consumption. As a new type of consumption pattern, there is ancharacteristics that rapid development and many problems exist at the same time.With the popularization of computer technology and diversified demands ofconsumption, the market of prepaid consumption is developing rapidly. According toiResearch data, China’s consumption market scale reached15936.65trillion yuan in2010. But the prepaid consumption also has many problem, especially the consumerright and interest have been violated. Complaints of prepaid consumption oftenbecome a hot spot of the complaints of the consumer. The China ConsumerAssociation has repeatedly issued a consumer alert to consumer. The prepaidconsumption issues seriously damage the interest of the consumers and affect thehealthy development of the prepaid consumer market. How to strengthen the legalprotection of consumers interests become a urgent problem.Focusing on the legal protection of the rights and interests of the consumers, I carryout the writing of this paper in accordance with the writing idea of “ask question,analyze and solve problems”. This paper consists of three chapters. The first chapteris the basic concepts of the prepaid consumer, including the definition andclassification of prepaid card, the definition and characteristics of the prepaidconsumption. The paper has a theoretical foundation through including of the basicconcept of the prepaid consumption. Chapter2includes the main case of theconsumers’ interests and rights being infringed and its reasons. I sum up thefollowing main situations through including the case in prepaid consumption: theconsumers’ rights to know, consumers’ fair trading right, consumers’ right tonsecurity and consumers’ privacy have been violated. In prepaid consumption, thereasons of consumers’ rights being violated have the following aspects: the laws andregulations of prepaid consumer is imperfect. The information is asymmetricbetween the consumer and the business operator. The consumer is not able toconsume rationally and lack the awareness of self-protection. Chapter3includes thelegal protection of the rights and interests of the consumers, focusing on thefollowing aspects: formulating and changing the law, establishing the system, guiding consumers to consume rationally and improve the ability of self-protection.
