Status And Countermeasures Research On Land Violations And Law Enforcement Supervision In Changle District

Land resources are the cornerstones of economic and social development.Land resource management is an important issue in China's modernization process because of its overall,strategic and basic value.At present,China's rapid industrialization and urbanization present the land resource management with a dilemma and double burden between economic growth and resource protection.To solve the problem of "protecting resources and ensuring development" is inseparable from land law enforcement and supervision.To curb the high incidence of violations of land resources law and regulations is an effective way to alleviate the pressure of resources from economic development,and so the importance of land law enforcement and supervision is self-evident.Based on the quantity,types and subjects of both discovered and filed illegal land cases in Changle District from 2012 to 2015,this paper analyzes in many aspects such as time sequence,spatial features,and human resources distribution,equipment configuration and workflows of the local land law enforcement,respectively.The main contents are as follows:(1)A total of 1490 land violations were discovered in Changle District during 2012 to 2015,covering an area of 180.1905 hectares.Through the data analysis of land illegal activities from 2012 to 2015,it is concluded that the land illegal activities in Changle District featured a wide range of areas,large quantities and obvious regional characteristics.So the overall situation was not optimistic,mainly in the suburbs of cities and relatively developed areas,especially in Jinfeng Town,Zhanggang Street,Jiangtian Town and Songxia Town,where extensive illegal cases on land occurred,accounting for over 54%of all land violations in Changle Distinct.Not only was there a large volume of illegal buildings and occupied land in Jinfeng Town and Zhanggang Street,but also there was high frequency of individual illegal housing financing and high-rise construction.In addition,illegal construction in some underdeveloped areas was on the rise.(2)There are some problems in the land law enforcement supervision in Changle District as follows:the land law enforcement supervision organization ranks low and is only the group leveled public administration institution that conducts according to the Civil Servants Law;the grass-roots law regulators has weak forces and poor patrolling supervision;the land law enforcement supervision team has some unreasonable structure,such as low educational background and many temporary employees;the land law enforcement supervisors lack some necessary security;there exist undocumented law enforcement acts,and half law enforcement personnel are undocumented;land law enforcement was weak.During the period from 2012 to 2015,the penalty disbursement rate of the whole illegal land use cases was 59.3%,demolition rate was 17.38%and confiscation rate 0%,and joint law enforcement mechanisms was absent.(3)This paper analyzes the motives of illegal subjects,the perspective of the government management and the propaganda,and comes to the following conclusions:the driving of economic interests;the out-of-control management,especially the role of grass-roots organizations has not been well played;and the insufficient policy propaganda to crack down on illegal construction are all the causes of the high incidence of land illegal activities in Changle District..(4)According to the situation of Changle District and the actual situation of land law enforcement and supervision in Changle District the paper puts forward the following improvement measures from four aspects,such as thought recognition,system construction,punishment and management control,and the responsibility to implement:①thought recognition:setting up the concept of prevention-oriented,ruling effectiveness and localized management;② system construction:combining redirecting and banning approaches,and establishing long-term working mechanism;③punishment and management control:strengthening propaganda,improving the level of law enforcement team,strengthening source control;④the responsibility to implement:strengthening supervision,strengthening assessment,and strictly rewarding and punishing.The writer hopes to try the best to reduce the illegal land use to smooth the path to land law enforcement and supervision work in Changle District.
