Patent Quality Assessment Based On Litigation Patent And Research On Patent Layout

With the increasing protection awareness of patents, the technology competition among enterprises is becoming more and more intense. Consequently, the infringement cases also have been increasing. In the fierce competition, the quality of patent is becoming more and more important. High quality patents ensure the high value of business products, reduce and avoid the occurrence of patent litigation and save cost for enterprises. Patent quality analysis will help enterprises to identify high quality patents from a large number of "junk" patents, which is of great significance for enterprises' patent layout work and the deployment of intellectual property strategy.Medical equipment is a sunrise industry which Chinese government supports a lot in recent years. There is a big gap between China and developed countries in terms of patent technology. So we should pay attention to the patent layout work. In this paper, data mining, patent quality, industry value-chain and the patent layout theory will be used to give a systematic analysis about patent information in the field of cardiac pacemaker in order to develop patent layout strategies for the government and enterprises and improve the overall competitiveness of medical device industry in China.In this paper, litigation patent is utilized as the proxy variable of high quality patent. Patent indicators are selected from the perspective of patent law, patent technology and market. Multiple data mining algorithms are used to construct the high quality patent recognition model. Then the validity of the model is verified. Latent Semantic Analysis(LSA) is used for mapping the patents to the industry value-chain based on reasonable construction. Research on the high quality patent layout of cardiac pacemaker is implemented from the perspective of industry value-chain. We summarize and complete the research framework of patent layout, implement the distribution of high quality patent, finish the holistic analysis and deep analysis based on the industry valuechain of pacemaker. Finally, patent layout strategies is provided for the government and enterprises.
