Agricultural land has "two-funded attributes"(individual households are assets,and resources in the country as a whole).Rural residential land has a dual function of residential security and asset capital,and asset capital functions are increasingly prominent.In 2007,China's 'Property Law" was promulgated,which defined the use right of homestead as a kind of utilities,which provided legal protection for the property capital function of homestead use right In 2015,the reform of the homestead system started in many places across the country.In 2017,the reform of the homestead system was promoted.In the Central Document No.1 of 2018,the home ownership base "triple power splitting”framework was formally proposed to maintain the collective ownership rights and confirm the right to homestead base and to liberalize the right to use the homestead.The use of the right to use residential land is essentially an extension of the function of asset capital outside the homestead housing function.Under the background of the deepening reform of the above-mentioned homestead system,this paper intends to use the capitalization of homestead land as the specific research direction,along the lines of theoretical exploration to practical investigation and demonstration,and on the basis of typical cases in some reform pilot regions,The characteristics of several operating modes of mortgage reform for homestead use rights at the current stage are summarized.The article focused on the research of Nankang village in Hannan District of Wuhan City as a research object.Through months of questionnaire surveys and in-depth interviews,the individual and household basic conditions of the village households,the family characteristics of the farmers,and the farmers' homes tead system and policies were recognized.Understand the situation and other situations to fully understand,and try to use Logistic model to study the farmers' right to use right as collateral to apply for mortgage loans,the main influencing factors,and the model results were analyzed.The preliminary conclusion is:The family's annual average net income,whether the peasant family is buying a house in a town,and the farmers' knowledge of the homestead policy are the three main factors that affect the willingness of homestead use rights to mortgage lbans.Based on the above studies,this paper proposes relevant policy recommendations for further improving the legal system of homestead right-to-use loans,establishing corresponding supporting financial systems,and re-evaluating the implementation path of homestead right-to-use loans.
