Study On Ineffective Patent Management And Value Development Research

In recent years,China has accelerated the implementation of the intellectual property nation.And the national innovation ability has been greatly improved.Advantages of invention patent application and authorization continue to expand.However,the duration of patent maintenance in China is relatively low in general.The average duration of the invention patent is only 6 years.Every year a large number of invention patents have been abandoned to maintain for various reasons.These patents are getting into public domain and become ineffective patents.But in fact the invention still has the value to be used.However,in actual management and application,the management of ineffective patents is still insufficient.On the basis of concepts and theories of the ineffective patent,this paper investigates and studies the demand of different types of scientific and technological enterprises on the ineffective patent,and puts forward research ideas on ineffective patent management and value development.First,based on reading a lot of literature,we will explicit definition and classification of ineffective patents;Second,using the method of interview and questionnaire survey to investigate the application of current ineffective patent,and analyze the enterprise's demand for ineffective patent and supply.Third,evaluating ineffective patents and build the ineffective patent application management platform.Fourth,managing the platform,including the design of the three mechanisms of operational mechanisms,management mechanisms,and safeguard mechanisms.The main conclusions of this paper are as follows:(1)All types of enterprises have a large difference in the demand for ineffective patent.The current intellectual property information platform and other supply methods can't meet the needs of the enterprise.It is of urgent and practical significance to build an ineffective patent application service platform.(2)The evaluation of ineffective patent value is the premise and basis of management.The invalid patent data can be classified by obtaining the evaluation weight of the invalid patent.(3)The management and value development of ineffective patents must rely on a management platform.The government agencies should take the lead,and the perfect operating mechanism and management mechanism should be used to ensure the good operation of the platform.
