In recent years,the legitimacy of Chinese primary and secondary school teachers in punishing students who have deviated from speech and conduct has been repeatedly questioned and criticized by various parties.Compared with foreign countries,China 's punishment legislation is still blank,which makes schools lack a basis for formulating a punishment system that is in line with the actual situation of the school.There is no clear requirement for the degree of punishment.Therefore,as the direct manager of the students,the teacher's education and punishment depends on himself.Once the parents do not recognize the teacher's punishment method or think that the teacher's punishment has been excessively sent to school Any trouble or report to the teacher directly,the teacher will be put on hats against teachers' morals,corporal punishment of students,the old style of education,for this reason,some teachers are frustrated and reluctant to give up punishment.In order to gain a deeper understanding of the current situation of educating and punishing teachers in junior high schools,the author conducted interviews and questionnaire surveys on junior and middle school teachers and students in Chengdu,S,where they work..The important reasons leading to these problems are firstly the unclear legal regulations on educational discipline;secondly,the lack of professional training of teachers' disciplinary ability,resulting in inadequate disciplinary ability of some teachers;thirdly,the lack of family education or the inability to lay a lot of hidden worries for the proper punishment of schools.In order to enable junior high school teachers to exercise the right to punish education properly,the author puts forward suggestions from five aspects: educationlegislation,teachers,schools,families,and society.First,the legislative proposal: improve the legislation of education punishment from three aspects: the substantive legal system,the procedural system,and the supervision and relief mechanism,including clearly specifying the subject,scope,basic principles,and forms of the implementation of education punishment right,and improve the family education legislation;second,improve Suggestions for teachers' personal disciplinary ability: Provide professional disciplinary training for teachers,help teachers establish a scientific outlook on education,discipline,and educating people,and guide their practice;third,it is recommended that schools build on education laws and regulations as the basis to establish Educational punishment system;Fourth,cultivate students' internal disciplinary spirit,develop a sense of awe of the rules and sense of responsibility after breaking the rules;Fifth,strengthen supervision of social media.Use its social influence to positively guide the proper exercise of the right to punish education.Studies have shown that proper education and discipline can promote the formation of strong personality of students,improve their sense of responsibility,and at the same time exercise their willpower and problem-solving ability,so that students develop the good qualities of distinguishing right from wrong and resisting various bad temptations;Legitimate education and punishment helps to maintain the normal education and teaching order of the school,and effectively guarantee the legal right to education of each student;legitimate education and punishment can help the country cultivate qualified citizens in the future,and then maintain a harmonious and stable society;legitimate education Discipline is more conducive to the formation of good parent-child relationships,so that each family can be more healthy and harmonious.
