| Over the past 20 years,labor dispatch has achieved great development in China as supplementary form of labor.The reasons of illegal labor dispatch in China can be found in labor disputes of Huadong Coach Company A.Illegal labor dispatch contains mainly five categories.The appearance of illegal labor dispatch is due to social factors and the shortages of labor law.Some work should be done to solve the problem of illegal labor dispatch: one is to continue improve the legal system of labor dispatch,and the other is strengthening the supervision of labor dispatch,including the permission of labor dispatch units,duty of common employers,annual verification,disclosure of information of illegal labor dispatch,responsibility of labor dispatch units and employing units,investigation and treatment of illegal labor dispatch units and employment services unit,appeal expression mechanism and rights-protection mechanism.In case of illegal labor dispatch,returning to dispatch of unit and fictitious labor relation should be reasonably chosen in dealing with the personal status relationship of dispatched employees. |
