Abstract/Summary:
With the advent of the Internet era,crowdfunding has gradually entered people’s lives,and rapid development at a higher rate,providing a bridge for both sides of financing.Network disease crowdfunding as one of the public crowdfunding mode,the same as the Internet as a platform,public welfare organizations or individuals as promoters,to the majority of fund-raisers financing.After the "Water Drop Fundraising" incident in 2019,the Ministry of Civil Affairs said that individual requests for help do not belong to charitable fundraising and are not within the scope of the Ministry’s statutory regulatory duties.The Ministry of Civil Affairs said the next step will lead the platform to amend the self-discipline pact.Therefore,there is a legal gap for the serious disease crowdfunding at present,which needs further regulation by law.This paper is divided into four chapters,the first chapter for network disease crowdfunding overview.Analysis and comparison of network crowdfunding mode at home and abroad.The second chapter points out the problems of our country’s serious disease crowdfunding.Through the analysis of typical cases,the representative legal issues of the public crowdfunding are summarized,such as the application of the law,the risk of the funds,the ownership of the remaining funds,the responsibility of theplatform for serious diseases,etc.The main causes of these legal problems lie in the lack of clear legislation norms,the overlapping of legal relations and the lack of legal supervision.The third chapter is to analyze the civil legal relationship of network disease crowdfunding in our country.According to the subjects involved in the network critical illness crowdfunding project,this paper analyzes the legal relations among the subjects and their rights and obligations.Based on the analysis of the above cases and the legal relationship,the fourth chapter puts forward some relevant suggestions for the problems in the actual situation.
