Research On The Legal System Of Online Public Welfare Crowdfunding In China

The rapid development of Internet technology has enabled us to enter a new era of “Internet+”.Philanthropy is no longer limited to charitable activities organized by traditional charitable organizations.It has developed into a new type of public welfare crowdfunding model with the help of network strength.With the rapid development of the public welfare crowdfunding model,public charity acts can no longer be solely depended on charitable organizations.The masses of the people only need to use mobile phones,computers and other communications equipment to quickly achieve “everyone's public welfare”.Internet public interest crowdfunding helps those who need help avoid cumbersome help-seeking procedures and can raise the funds they need in the shortest time to solve the problems of real medical care and education.However,due to its rapid development,it has many problems in terms of supervision.First,related regulatory legislation is incomplete.The "Charity Act" clearly states that the main body of its regulation is a charitable organization.It neither prohibits personal Internet aid activities nor regulates personal network rescue behavior.Second,the lack of disclosure of donation information has triggered a credit crisis.Fraud cases have frequently occurred and have deviated from the normal development of public welfare undertakings.Third,the issue of supervision of network public interest crowdfunding needs to be improved.No matter whether the external regulatory agency or the internal regulatory system has no corresponding laws to regulate it,a systematic and comprehensive supervision system has not been formed.Fourth,when illegal activities in public welfare crowdfunding on the Internet cause harm to the rights and interests of donors,there is no uniform legal liability mechanism to investigate them.Through the comparison of the status quo of the overseas public interest crowdfunding development and the supervision regulations of overseas countries on network public interest crowdfunding,combined with the problems existing in China's online public interest crowdfunding supervision,after drawing lessons from regulatory laws concerning online public interest crowdfunding in overseas countries,China's online public interest crowdfunding supervision laws have made the following improvements: to improve the relevant laws and regulations of network public interest crowdfunding,to define the online public interest crowdfunding platform and the qualifications of crowdfunding promoters,and to solidify the foundation of network public interest crowdfunding;Mechanism and Crowdfunding Credit System to Solve Crowdfunding Credit Crisis;Network Public Interest Crowdfunding Regulatory System is Crucial.On the one hand,it defines the external regulatory agencies for charitable crowdfunding;on the other hand,it regulates the online public interest crowdfunding platform's own regulatory system.When the relevant entity violates the law,a strict legal responsibility investigation mechanism is required to determine the legal liability of the entity.
