Research On The Recovery Of Property Involved In Illegal Fund-raising Cases

In recent years,illegal fund-raising cases take place frequently and the amount involved and the number of participants have been kept increasing.Along with the social development,the illegal fund-raising measures have been constantly updating,involving aspects of P2 P online lending platform,private-equity fund,virtual currency and so on,resulting in challenges in case identification.In addition to causing huge economic losses to fund-raising participants,such cases also severely breached our country’s financial management order.Unlike criminal cases,those who suffer economic losses from such criminal cases are more concerned about the recovery of funds.A plenty of participants have suffered great losses and are prone to form vicious mass incidents.In addition,the local financial system will be stricken in different degrees due to the huge amount of money involved.In order to effectively deal with the current cases of illegal fund-raising,the investigative organization should not only focus on investigating the criminal facts,but also pay attention to the asset recovery and retrieve,enabling the recovery work be the center throughout the investigation process.This paper is divided into four parts,the first part of illegal fund-raising and involved property overview,analysis of the current situation of illegal fund-raising and illegal fund-raising involved property identification.The second part focuses on the present situation of illegal fund raising and recovery of stolen goods.The third part analyzes the reasons for the low recovery rate of illegal fund raising and points out the adverse consequences of the low recovery rate of illegal fund raising.In the fourth part,from the perspective of countermeasures for recovering stolen goods,the author makes clear the number of illegal fund-raising cases from the aspects of personnel and funds,and proposes different methods for recovering the funds involved in different directions.In addition,in view of the current situation of the difficulty in recovering the funds involved,this paper proposes some countermeasures,such as flexible use of coercive measures in custody and the establishment of creditors’ committee.In view of the current situation of serious shrinkage of the assets involved in the case,the paper puts forward the measures to maintain and increase the value of the assets involved in the legal scope,so as to improve the illegal fund-raising cases of the recovery and loss.
