Research On The NIMBY Conflict In Base Station Construction And Its Countermeasures

Acompany with the rapid development of the mobile communication infrastructure construction,there are more and more conflicts in the construction of mobile base station.Because of the widespread rumor that the “base station has radiation”,a lot of residents believed that and often resort to irrational protest against the construction of mobile base stations,the increasingly serious NIMBY conflict of base station has seriously affected the development of the quality of communication service industry in China.This paper mainly adopts the perspective of "NIMBY",presents a theoretical analysis of the disputes and conflicts arising from the construction of mobile communication base stations based on the Existing NIMBY research results of scholars at home and abroad;Then Interpret the Construction Mode of the whole Mobile Communication Base Station combined with the current situation of mobile communication base station construction in China,Such as the establishment of China Tower,the vigorous rise of Private Outsourcing companies;Finally,the corresponding countermeasures are put forward.In terms of research methods,in addition to the literature research method and theoretical analysis method,the paper also adopt the comparative analysis method,the case analysis method and so on to carry out the research.First,select Two aspects of literature in the study of existing literature,On the one hand,there is a description,analysis,response to the conflict of base station construction;on the other hand analysis and bring up a solution of “NIMBY” theory.Finally,two typical cases were selected and the results were compared reveal the reason of "NIMBY" conflict caused by the construction of base station in China,point out matters needing attention in the construction of base station.After the above academic research,it should be recognized that the problem can't be solved completely whether the construction party's behavior of removing or changing the location of the base station in the NIMBY conflict caused by the construction of the base station.The demolition of the base station will result in weak signal coverage of the whole community,which will affect the mobile phone communication of the whole community.Although the change of location has temporarily solved the problem of signal coverage,However,there is still the possibility of conflict after being discovered without prior notification to nearby residents.In addition,there may also be internal disputes within the residents of the community because of the construction or demolition of mobile communication base stations.It is easy to fall into the cycle of "base station construction-residents protest-base station demolition-residents demand reconstruction".It is a long and complex struggle to solve the problem of NIMBY in the construction of mobile communication base stations.The reason why the construction of base station will cause many disputes is mainly due to the incomplete laws and regulations,inadequate planning of public facilities and imperfect process of base station construction.In order to deal with the NIMBY conflict countermeasures of mobile communication base station construction,we must protect the legal rights and interests of the base station construction by using legal weapons and this is necessary to accelerate the promulgation and implementation of the Telecommunication Law.Taking measures such as introducing expert judges and prior publicity to comprehensively design and enhance the scientific,feasible and effective selection of the site to optimize the location selection process.Strengthening government supervision.First,through the joint efforts of all departments to ensure the normal operation of the base station construction.Second,set an example by the role of government departments themselves in supporting the construction of mobile communication base stations.Publicizing popular knowledge of science and dispelling radiation rumors requires the joint efforts of China Tower,telecommunications operators and all sectors of society to publicize on the media platforms and create a good atmosphere for popularizing science in the communities,schools and other public places.Compensation mechanisms should be established to compensate the base stations occupied in the public areas within the community and the residents affected by the base stations.However,due to the fact that direct economic compensation should be avoided in order to avoid causing other disputes,people may be compensated in disguised ways,such as the return of telephone fee coupons,the recharge of data,the free use of broadband,and so on.Deepening facility sharing,make a change of "mobile tower into social tower,social tower into mobile tower".Building a multi-pole unified communication tower,save construction cost and share social resources.Only by taking the problem of NIMBY caused by mobile communication base station construction seriously and solving the problem after analyzing it's characteristics can better help the development of mobile communication in China.
