| The protection of the rights of women workers in the "three phases" is an aspect that our country needs to focus on now and in the future.The protection of the rights of female employees in the "three phases" involves the immediate interests of female employees who are in the pregnancy,childbirth and lactation periods,as well as the sharing of child-rearing and family responsibilities.It is conducive to reducing the economic pressure of female employees during pregnancy,lactation and lactation breaks,and it is also conducive to building a harmonious family and a harmonious society.At present,there are not a few articles on the protection of the rights and interests of women workers in the "three phases",and the research scope is quite extensive,but most of them are from various disciplines such as sociology,gender,feminism,and public management.Of course,there are also studies from the perspective of law,but in fact,there are not many articles from the legal empirical direction.For this reason,the article mainly uses the legal empirical analysis method to study the implementation of female employees’ "three-phase" rights protection in practice in the current period,finds and summarizes problems,and finally proposes countermeasures to improve the problems.The article first reviews the current status of the "three phases" of the rights of female employees in China from the three aspects of national level legislation,local level legislation and relevant provisions in international labor conventions.The main problems faced are summarized.When the problems are found and summarized,the legal empirical analysis method is mainly used.This article analyzes the current court judgments in various areas in the country in recent years.During the period,what problems should be paid attention to in the implementation of the "three-phase" rights protection system for female employees,and to explore the deep-seated reasons behind these problems.In order to solve the problems in the protection of the rights of female employees in the "third phase",based on the advanced experience of foreign countries and in combination with China’s basic national conditions,it is proposed that we should adhere to The two basic principles of antecedent legislation and equality between men and women,and put forward the perfect countermeasures for theprotection of the "three phases" of the rights of women workers in China from the stages of pregnancy,childbirth and breastfeeding.The effective implementation of the “three-phase” rights protection policies for female employees will help improve the severe form of female workers in the job market and help alleviate the childcare pressure of young workers ’parents.At the same time,Physical health and life safety are of vital significance for maintaining social fairness and justice and protecting women’s human rights in the new era.Therefore,the implementation of the "three-phase" rights protection policy for female workers requires the active attention of each of us.And to contribute our own strength,we also need to actively and seriously analyze and study,and finally improve and implement. |
