Research On Administrative Law Regulation Of Network Rumors

Network rumors have intensified against the background of the increasingly developed media,and the public has been deeply disturbed by them.Many people have panic,damage their reputation,and have suffered economic losses due to network rumors.There are many ways to manage online rumors.Law is one of them without exception,the administrative law itself has the characteristics of flexibility,specialization and high efficiency,in reality,most of the network rumors are regulated by administrative law means and administrative regulations are the most common and indispensable important means.In order to establish a reasonable and efficient system of administrative rules and regulations for network rumors,it has important theoretical and practical value to study the regulation of Internet rumor administrative law.Through research findings,there are some problems in the regulation of Internet rumors in our administrative law,such as imperfect legislation system,unclear procedural provisions,untimely regulation,many regulatory subjects and overlapping powers.The reason is that the government information disclosure is not in place,the administrative legal system is not perfect,the main body of regulation is not clear,the way of regulation is single,and the punishment of violators is not effective.Therefore,we should take into account the actual situation of our country and learn from foreign experience,we can refine the existing legal provisions and procedural provisions to improve the administrative legal system of Internet rumor;By giving full play to the leading role of administrative organs,guiding the autonomy of Internet industry organizations,and strengthening the supervision of Internet service providers,we can establish a diversified regulatory system of Internet rumor administrative law;By standardizing the publicity of government information,improving the technical guarantee of the real name system of the network,and using the mechanism of refuting rumors and early warning to improve the supporting mechanism of the regulation of the administrative law of the network rumors;We should also attach importance to public participation,improve the legal awareness of Internet users,strengthen international exchanges and cooperation,and constantly improve the use of administrative law to regulate network rumors.
