Research On Regulation Of Administrative Law On Road Test Of Self-driving Vehicles

As an important stage before the commercial application of autonomous vehicles,the road test determines the overall trend of the self-driving industry and the comprehensive competitiveness of the country.The specifications about autonomous vehicle road test have been released in some domestic key cities,mainly to protect consumers’ rights,promote the orderly development of the industry,and indicate the research direction for the enterprise.However,it still exists many problems in the regulation.Based on the present situation of administrative law and regulations,the article compares most automatic vehicle road test specification details and gives some suggestions for the current administrative law regulation improvement,referring the present issues arising now and experience the other developed countries have in self-driving regulation.Four parts are divided as below:The first part mainly introduces the concept of administrative law regulation of road test for self-driving vehicles and clarifies the purpose of administrative law regulation of road test for self-driving vehicles.The concept is organized around the subject,object and means of regulation,and the purpose is explained from the perspectives of safety,consumers,transportation and industry.The second part mainly analyzes specification details related to the automatic vehicle road test,and studies the similarities and differences between cities around the main body,object and means.Then it finds and summarizes problems arising from the present specification and regulations,like subject power and responsibility which is not clear,narrow object range and the regulation inefficiency;The third part mainly summarizes the experience of some countries overseas in the regulation of self-driving vehicles.Based on China’s national conditions,it will be improved from three aspects: perfecting relevant laws and regulations,establishing a complete and unified test and evaluation system and building an intelligent closed test site.The fourth part mainly improves the administrative law regulation of self-driving vehicles in road test.We can detail road test admission from the test subject,test vehicle,test driver,and establish a systematic regulatory mechanism through the introduction of due process,innovation of diversified regulatory model,the implementation of data reporting safety mechanism,so as to clarify the responsibility distribution in road test and promote the renewal of insurance system.
