Since the promulgation and implementation of the "Regulations on the Handling of Labor Disputes by Enterprises of the People’s Republic of China" in 1993,the labor dispute handling system of "one arbitration,one arbitration and two trials" has been continuously improved and developed,the laws and regulations of mediation and arbitration have been increasingly improved,and the work mechanism of mediation and arbitration has been continuously improved.The mediation mechanism has basically been formed,the mediation and trial connection mechanism has been continuously optimized,the multi-level mediation network has been fully expanded,the adjustment and arbitration team has been continuously expanded,and the diversified processing pattern of labor and personnel disputes has gradually taken shape.It has played a role in building a harmonious labor relationship and maintaining social stability.Important role.With the rapid development of China’s economy and society,the comprehensive deepening of reforms is advancing in depth,the country’s economic transformation and upgrading are speeding up,the private economy and small and medium-sized enterprises are booming,the new economy and new business forms such as "Internet +" are flourishing,and the modern enterprise system is constantly improving.,Full-time,part-time,labor dispatch,labor outsourcing,civil agreement and other new and old employment forms are intertwined,labor-management conflicts have become an important part of China ’s social conflicts,and the number of labor dispute cases has been at a high level in recent years.With the increasing complexity,the proportion of group cases continues to increase,and labor disputes have become an important factor affecting the harmony and stability of our society.Labor dispute arbitration,as the main way to resolve labor disputes in China,plays an active role in ensuring people’s livelihood and maintaining stability,but social functions are not fully played,and there is still a big gap between the needs of social governance and the expectations of the people.For example,the lengthy procedures,the ambiguity of the tripartite principle,the low mediation rate,the low level of professionalization of the team,and the lagging institutional construction have severely restricted the healthy development of the labor dispute arbitration cause,which is not conducive to the timely and effective resolution of labor disputes,and is not conducive to long-term social harmony and stability.The call for reforming China’s current labor dispute handling system is increasing.The Ministry of Human Resources and Social Security and local human resources and social security departments have increased their research efforts year by year,and are constantly exploring innovative new models for handling labor disputes.This article takes the labor dispute arbitration work of Neijiang City as the research object,adopts the literature research method,case analysis method,data analysis method,international comparative law,logical analysis method and other research methods,and analyzes the labor dispute arbitration related concepts,social values,work principles and domestic The foreign operation machine briefly introduced the development history and operation status of China ’s labor dispute arbitration system,and then looked at the labor dispute arbitration work in Neijiang City,analyzed the shortcomings of China ’s labor dispute arbitration system,and explored new development paths.,Propose countermeasures to solve the problem.It is recommended that the state further improve China’s labor dispute arbitration work structure and handling mechanism,increase the organic connection of mediation and review,and give full play to the important role of labor dispute arbitration in resolving social conflicts,maintaining social stability,and ensuring national economy and people’s livelihood.
