Research On Legal Regulation Of Online Fund-raising

As a way of showing love and providing help to those in need,online fund-raising not only makes it more convenient for donors to find donation channels so as to complete donations,but also enables more people in need to get help to a greater extent.This flexible and efficient way of fund-raising has not only greatly accelerated the development and popularization of fund-raising,but also has become a powerful supplement to the social security system of China.With the introduction of the Charity Law and other relevant laws and regulations,fund-raising behavior has been regulated and adjusted by law,yet online fund-raising is not used as a professional legal concept,and there is no special law to regulate online fund-raising activities systematically.On the whole,the legislation environment of online fund-raising in China is relatively backward so the development of online fund-raising is still faced with some problems in practice.Taking the basic concept of online fund-raising as the starting point,this paper analyzes the development of online fund-raising in practice and the current legal regulation of online fund-raising.What’s more,it attempts to link online fund-raising activities with the trust system,introduces the relevant theories of trust relationship into online fund-raising,and clarifies the rights and obligations of the parties concerned in online fund-raising,so as to find a better way to regulate online fund-raising.This paper falls into four parts.The first chapter makes clear the definition of online fund-raising,differentiates it from other similar concepts;analyzes and compares different theories and viewpoints on the legal nature of online fund-raising to draw the most reasonable conclusion on the trust behavior theory.The second chapter focuses on the analysis of classic cases in order to reveal the problems in the development of online fund-raising and analyze the causes.It also deals with sorting out the relevant parts of online fund-raising in the current legal system so as to put forward more targeted countermeasures and suggestions in the last chapter.The third chapter introduces the position which the fund-raising and the parties concerned hold in the trust structure as well as the rights and obligations of the parties concerned in terms of online fund-raising.In the fourth chapter,some suggestions for perfecting the regulations of online fund-raising are putforward based on the research and analysis above.
