Research On The Legal System Of Certification Supervision Of Organic Agricultural Products

Organic is a heated debate in recent years,Organic agricultural products are showing a wider and wider market.However,due to the constraints of the social environment and the lag of laws,the phenomenon of "pseudo-organic" is still emerging.The quality of organic agricultural products is not guaranteed,andConsumer rights are damaged,and organic agricultural products are facing a large crisis of trust.From a scientific perspective,organic agricultural products have higher food safety and health value than ordinary agricultural products.This is also the main reason why organic agricultural products are more and more popular.Organic certification is an important line of defense to ensure food safety and health,Therefore,it is necessary to continuously improve China’s organic agricultural product certification and supervision system.Apart from the preface and conclusion,the research content of this paper is mainly divided into four parts:The first part is an overview of organic agricultural products and their certification and supervision.It introduces what is organic agricultural products and certification and supervision of organic agricultural products,the legal significance of certification and supervision of organic agricultural products,and the current situation of certification and supervision of organic agricultural products in China.The second part is the main problems existing in the certification and supervision of organic agricultural products in China.This paper analyzes the existing problems in the legal basis of current certification and supervision,the legal status of certification institutions,the legal responsibility of each subject and the problems in social supervision.The third part is the introduction of the international experience of the certification and supervision system of organic agricultural products,in which the European Union and the United States,a typical country,are analyzed.It is worth learning from the legislative support at the national level,the establishment of special regulatory agencies and scientific and strict punishment mechanism.The fourth part is the legal suggestions for improving China’s organic agricultural productcertification and supervision system.By combining the experience of developed countries,it is proposed from three aspects: perfecting China’s organic certification and supervision related legislation,establishing and operating an efficient supervision system,and clarifying the legal responsibilities of each subject.
