Research On Shanxi Forest Protection Legal System In The Early Period Of The Republic Of China

Since Yan Xishan became the governor of Shanxi Province in 1917,the Shanxi Provincial Government has implemented a series of decree to develop the people's livelihood in Shanxi and improve people's lives.These measures mainly include the "three things" of "water conservancy,sericulture,tree planting,smoking ban,sky foot,hair cutting" and the "three things" of "cotton planting,afforestation,animal husbandry",collectively referred to as "three things of six politics".The implementation of the "six politics and three things" has achieved good economic results,making Shanxi Province a "model province" in the country.Among them,"planting trees" and "forestation",as an important part of the Three Political Affairs and Three Events,played a significant role in the establishment of the "model province." On the one hand,it shows that it promotes the economic development of Shanxi Province,and on the other hand,it promotes the protection of forests.The implementation of the policy is inseparable from the guarantee of the legal system.It is precisely because Shanxi formulated a large number of forest protection regulations at the beginning of the Republic of China that Shanxi's forest protection realized the dual benefits of economy and ecology.With the increasing emphasis on environmental protection today,the study of the legal system of forest protection in Shanxi in the early period of the Republic of China has not only theoretical value but also practical significance.In addition to the introduction and conclusion,the article is divided into five parts.The first part studies the background of the Shanxi forest protection legal system in the early Republic of China.Through research,it was found that the introduction of the Shanxi forest protection legal system at the beginning of the Republic of China was,on the one hand,due to the economic withering and frequent ecological disasters in Shanxi Province,making forestry development urgent,and on the other hand,due to the existence of a large number of barren mountains and wasteland in ShanxiProvince,the geographical advantage was forest The development of protection offers possibilities.The second part summarizes and analyzes the content of the legal system of forest protection in Shanxi in the early period of the Republic of China.After combing through a large number of regulations and decrees promulgated by Shanxi in the early Republic of China,Shanxi's forest protection legal system mainly included the subject system,the security system,the supervision system and the liability system.Among them,the main body of the forest protection legal system covers the people of the whole province;the guarantee system consists of the education system,the afforestation system and the banned inspection system;the supervision system reflects the characteristics of strict implementation from top to bottom;the responsibility system emphasizes rewards Punishment is supplemented.The third part examines the implementation of Shanxi forest protection legal system in the early period of the Republic of China.The competent forest protection authority mainly conducts propaganda,guidance,supervision,and rewards and punishments,and this agency participates in the implementation of forest protection with other agencies and people.Therefore,the implementation of forest protection shows the characteristics of government-civilian co-organization and full participation of all members under the guidance of the government.The fourth part explores the characteristics of Shanxi forest protection legal system in the early period of the Republic of China.The main characteristics are as follows: first,the legislative purpose is ecological,economic,and national;second,the formulation and implementation of laws reflect the people-oriented legal thought;finally,the effective experience of Shanxi forest protection law practice at the beginning of the Republic of China lies in Government-civilian co-organization,full participation.The fifth part draws the contemporary reflection on the legal system of forest protection in Shanxi in the early period of the Republic of China.Although some achievements have been made in forest protection andconstruction in Shanxi in the early Republic of China,there are also problems in forest protection that give prominence to the economic benefits of forests;a strong administrative color in practice;and the implementation effect needs to be strengthened.However,the content and the implementation of the concept of the rule of law that emphasizes legislation and the implementation experience that advocates the active participation of the people are still worth learning today.
