| As the capital of the Tibet Autonomous Region,Lhasa has been progressing steadily in recent years,and the legal framework has become more and more perfect.However,there are still undercurrents under the glory scene,and customary law still plays a major role in local dispute resolution.In the case of private lending disputes,local residents,due to the influence of customary religions,excessive judicial costs,and inefficiency,do not use litigation and other statutes,but adopt peaceful means,sub-violent means and other common law solutions.It has formed a dispute resolution mechanism in which customary law and statute law meet and priority is given to the use of customary law.This set of mechanisms came into being,in which the statute law provided protection for customary law,and the customary law filled the gaps in the statute law.It provided a way for the residents of Lhasa to resolve disputes in the past years and promoted local economic development and social harmony.However,the inherent defects of customary law and statute law have brought about problems such as the conflict between customary law and statute law,and the vacuum zone of dispute resolution mechanism,which has hindered the development of the local future.In order to improve the local dispute resolution mechanism and maintain social stability,the author advocates the establishment of a diversified dispute resolution mechanism,and incorporates alternative approaches into the legal supervision while continuing to promote the rule of law,with a view to establishing an efficient and harmonious dispute resolution system. |
