A Study On Alternative Dispute Resolution At Grassroots Level

At present,with the continuous development of China’s economy and society,social governance issues occur frequently,litigation cases continue to grow,and many unnecessary lawsuits waste a large amount of litigation resources.On this basis,the national level has vigorously promoted social governance reform and innovation,and issued relevant documents to improve the multiple resolution mechanism for conflicts and disputes,indicating the direction for resolving conflicts and disputes.Alternative dispute resolution has become an important component of grassroots dispute resolution due to its flexible and convenient characteristics.With the continuous changes in conflicts and disputes,grassroots alternative dispute resolution also faces higher demand.Intelligent dispute resolution,participation of multiple entities,linkage between government and courts have become the future development trend of alternative dispute resolution.Taking the alternative dispute resolution model of F Sub-district as the research object,this paper conducts qualitative and quantitative analysis and research on the alternative dispute resolution of F Sub-district by using case studies,interviews,questionnaires and other methods,and using relevant theories such as multicenter governance,right relief,and collaborative governance.The aim is to provide research reference for the resolution of grassroots conflicts and disputes in China by studying the resolution of alternative dispute resolution in F Sub-district.Starting from the alternative dispute resolution service center set up in F Sub-district,this paper analyzes the service content and service process of the center,introduces the current practice of introducing courts,law firms,social organizations and other institutions into the alternative dispute resolution in F Sub-district.Through such experience and practice,F Sub-district has resolved more than 10000 disputes over the past three years,and there has been no vicious dispute related to "intensification of disputes" and "conversion of people to punishment".While analyzing the results achieved,this paper also proposed the current problems in resolving alternative dispute in F Sub-district,and analyzes its achievements,and also puts forward the current problems in the alternative dispute resolution in F Sub-district,mainly including the low efficiency of resolution leads to a backlog of cases,insufficient allocation of alternative dispute resolution resources,the dispute resolution agencies are lack of coordination,the mediation documents are lack of legal protection,and the dispute resolution channels are single.Through interviews,questionnaires,literature review and other methods,find out the causes of the problem,and learn from the advanced practices at home and abroad,this paper proposes to optimize the alternative dispute resolution work of F Sub-district from five aspects:optimizing the alternative dispute diversion procedure,strengthening the alternative dispute ideological understanding,establishing the coordination and linkage mechanism,improving the judicial confirmation procedure,and enriching the dispute resolution path,so as to improve the efficiency of the grass-roots conflict resolution,Comprehensively improve the level of alternative dispute resolution at the grass-roots level,and enrich the theoretical research of alternative dispute resolution at the grass-roots level.
