A Study Of The Linkage Mechanism Of Civil Enforcement

The difficulty of civil enforcement has been a chronic illness of the judiciary in China.It has led to negative impact on social harmony and stability and hindered the reform of judicial system of our country to some extent.In order to cope with the difficulty of civil enforcement,the People’s Supreme Court took the lead and set up the linkage mechanism of civil enforcement,an innovative mechanism with unique characteristics of China.This mechanism is attached to the system of assistance in the civil enforcement.Its main function is to adjust the internal relationship between the people’s court and the assistance unit,and to enhance the legal obligations of the assistance unit,so as to effectively connect with the deterrence mechanism of civil execution to reach the purpose of maximum implementation.Taking the implementation of the Opinions of Several Issues Concerning the Establishment and Improvement of the Linkage Mechanism as a prerequisite,the mechanism has upheld the leadership of the Party,depended on the in-depth linkage of the government and all sectors of society,and formed a new pattern for enforcement in which the court links with exterior units and the member units link with each other horizontally and work together.Therefore,the thesis analyzes the relationship between the linkage mechanism of civil enforcement and the deterrence mechanism of civil enforcement from theoretical aspects,systematically dissects relevant theories concerning the linkage of civil enforcement through the doctrine of double attributes,analyzes the data obtained from the field research undertaken in some League(City)of the Inner Mongolia Autonomous Region from practical aspects,concludes certain cases,and puts forward legal solutions and supporting measures for improving the linkage mechanism of civil enforcement and opening up new paths for solving “the difficulty of enforcement” in our country.
