| Food safety is a necessary prerequisite for human survival,and children’s food safety is an important foundation for human development.In recent years,while advocating "maximizing children’s interests",children’s food safety issues such as the "Big Head Doll" incident in Fuyang,the "Living Insect Gate" incident in Meisu Milk Powder,and the food poisoning incident in "Wu Mao Food" have been gradually revealed It makes the public have serious doubts about the government’s comprehensive governance capacity,and the demand for the government to strengthen the supervision of children’s food safety and punish children’s food violations is increasing.At this stage,how to improve the government’s food safety supervision capabilities and build a complete children’s food safety supervision system has become a practical issue we have to face.Based on the chaotic structure of the children ’s food market but not being effectively regulated,this paper discusses the problems existing in the supervision of children ’s food safety,analyzes the causes of the problems,and puts forward targeted suggestions from the practical perspective.The first chapter analyzes the theoretical basis of children’s food safety supervision,which is divided into three parts: firstly,the related concepts of children’s food safety supervision are expounded.From different perspectives,children are defined as anyone under the age of 18,and the basic children’s food covers children’s main supplementary food,casual snacks,health food,nutritious lunch and other types.Power supervision is the core multi-party supervision mode.Secondly,it analyzes the particularity of children’s food safety supervision from the perspective of law and physiology.Factors such as children’s own dependence,vulnerability and uncertainty of children’s food safety require special supervision of children’s food safety supervision in terms of supervision subjects,supervision methods,supervision standards,supervision basis,etc.,in order to improve children’s all-round Effectiveness of food safety regulation.Third,the necessity of strengthening food safety supervision for children is proposed from the perspective of various disciplines.First,from the perspective of economic theory,it is proposed that strengthening the supervision of children ’s food safety is the first essential to maintain the order of the children ’s market;second,from the perspective oflegal theory,that children ’s food safety supervision is the essential requirement for the maximization of children ’s interests;From the perspective of academic theory,it is an inevitable requirement for the country to nurture and deliver qualified future citizens for the country to strengthen food safety for children.The second chapter takes the current situation of children’s food safety supervision as the base point,and through the analysis of existing cases,summarizes the problems existing in China’s children’s food safety supervision.Obviously,the current structure of China’s children’s food market is chaotic.Foods that use "children’s exclusive" as the selling point are very popular,and "three no foods" are even beyond the law.Campus food incidents are frequent.According to the current laws and regulations of our country,neither the setting of regulatory subjects nor the formulation of laws and regulations have considered the particularity of children themselves to the greatest extent,which ultimately led to the existence of low market entry barriers and regulatory authorities in China ’s children ’s food safety supervision.Problems such as insufficient administrative enforcement,uneven urban and rural supervision,and low public participation.The third chapter is based on the analysis of the status quo,in-depth analysis of the causes of problems in children’s food safety supervision.First,in essence,China currently does not have a specific child food safety standard.The lack of standards and unclear definition of children ’s food are not only the key to the ineffective supervision,but also the chaotic structure of the children ’s food market.The main factors;secondly,in terms of the rule of law,China has no special child food safety laws and regulations,decentralized legislation and the ambiguity of accountability are reserved for children ’s food safety violations to some extent.Illegal space;third,from a system perspective,China ’s current child food safety supervision system is not perfect,and child food safety supervision is accompanied by general food supervision,and the unclear division of responsibilities often leads to child food safety supervision in a blank zone.The "supervised" supervision method cannot fundamentally solve the problem of children’s food safety.The lack of supervision personnel makes the urban and rural children’s foodsafety supervision appear to be polarized.The fourth chapter puts forward suggestions for perfecting the problems existing in the current children’s food safety supervision system,combined with the research results of domestic and foreign scholars.One is to formulate special children’s food safety standards to provide basic premises for ensuring the quality and safety of children’s food;the second is to improve relevant laws and regulations,formulate special laws and regulations for children’s food,and promote food by increasing accountability Production operators and regulatory authorities take the initiative to regulate their own behavior.The third is to optimize the existing supervision system,set up a special supervision department,and regulate the law enforcement behavior of the supervision department to maximize the effectiveness of government supervision.The fourth is to promote the information disclosure system,establish a special children’s food database,and solve the problem of asymmetry of food information to the greatest extent through data sharing.Finally,it emphasizes the need to raise public awareness of food safety and eliminate the hazards of unsafe food from the source. |
