Investigation And Research On The Implementation Of Legal System Of Ecological Protection In Gannan Pastoral Area

With the implementation of grassland ecological protection legal system,the ecological environment of Gannan grassland has improved.However,the ecological compensation can't make up the income loss for increasing the breeding cost and reducing the breed numbers,due to fewer rainfall,overgrazing,pests & mice,disorderly cut down a tree and mining of medicinal materials,the contradictions of economy-ecology are still outstanding,the ecology of grassland is still fragile,continued degradation needs to be addressed.How to resolve the contradiction between the economic development and the ecological protection,accelerate the grassland ecological improvement,promote the development of grassland husbandry and move the unification of economy-ecology is undoubtedly a major challenge for implementing law system of grassland ecological protection in Gannan pastoral area.This paper followed the paradigm from normative interpretation to constructing scheme,integrated use the method of empirical research and qualitative research,made an active exploration in trying to break through the study limitations of law system for grassland ecological protection,and further solving the economy-ecology contradiction in Gannan pastoral area.In order to make a panoramic description for grassland thesis,the bibliometrics and system evaluation were based on CNKI and other mainstream database.The core elements of grassland ecological protection in laws are analyzed and studied with the qualitative analysis of three grassland laws.Using the traditional methods of social investigation and qualitative research,this paper makes a quantitative analysis of the first-hand data obtained from the survey questionnaire,and makes a full-text analysis of the interview data,attempting to provide sufficient empirical data for the improvement of legal system for grassland ecological protection in Gannan pastoral area.This paper explored and revealed nine aspects: the benefits of grassland contract needs to be discussed,grassland circulation needs to be standardized,cooperatives of graziery still have a long way to go,the degradation situation has not been totally reversed,grazing withdrawal project needs to be strengthened,grassland fence is a double-edged sword,the imbalance of grass and livestock is large,and the livelihood of immigrants needs to be planned.And on the basis of this,the paper puts forward some suggestions on the improvement of grassland circulation clauses in Regulations on Grassland of Gansu Province,as well as the implementation of relevant legalsystems:accelerating grassland contracting,improving grassland management,strictly control grassland circulation,standardizing cooperative operation,consolidating grazing withdrawal project,strengthening the balance of grass and livestock,improving the livelihood of the migrants and examining the effect of grassland fence.In order to provide objective evidence and path reference for law decision improvement and legal system innovation of grassland ecological protection in Gannan pastoral area.
