Sharing economy has been springing up all over the world for ten years,but various economic forms entering our country are still developing vigorously.The beginning of sharing economy is the result of economic globalization and depends on network coverage,but the explosive growth of sharing economy is closely related to the change of social and cultural environment.Today's society is rich in material resources as never before,the spirit of cultural pluralism and democratic freedom is increasingly important,and the desire of young people for an open and diverse cultural life is particularly strong,the choice to participate in the sharing economy is also the youth group's choice of their own way of life under the background of the present age.In order to promote the further development of the market economy,but also to avoid possible problems in advance,the author chooses to start from the current situation of online bed and breakfast short-term rental.Through the detailed analysis of the sharing economy and the development of Online bed-and-breakfast short-term rental platform,the paper shows the problems in the development of the sharing behavior.And try to draw on shared accommodation has long occupied the market in Europe and the United States experience,analysis of the platform in the development of common problems,combing the two countries the same or different legal regulation methods and content.Based on the above methods and discussions,this paper analyzes the social environment and legal system of our country,and puts forward corresponding suggestions on the legal regulation of shared accommodation in our country.The article is divided into four chapters.In the first chapter,the basic concepts and characteristics are analyzed,and then the growth and development of the sub-concept of shared accommodation platform are introduced,in-depth study of the operation mode and characteristics of shared accommodation platform.The second chapter of this paper describes the development status and existing problems of the shared accommodation platform in China.Firstly,this chapter analyzes the reasons why the American Unicorn Enterprise AIRBNB has been cold in China,it's platform warfare and cultural influence.In addition,according to the logic of the table and the inside,this paper demonstrates the legal regulation problems in the context of shared accommodation from four aspects: Imperfect Trust system,imperfect security guarantee,difficult definition of platform legal status and possible tax problems,analysis of the legal regulation of China's shared accommodation platform of the loopholes.In the third chapter,the author introduces the problems and countermeasures in the process of the birth of airbnb in foreign countries,that is,urban planning and the main body of differentiation.The Fourth Chapter of this paper puts forward some legislative suggestions on the regulation of shared accommodation platform.Firstly,the legal status of online bed-and-breakfast short-term rental platform is defined,and the shared accommodation is brought into the scope of legal regulation.Secondly,the trust mechanism of the platform is combined with the national credit system,and the market access standard and the credit system are developed simultaneously.In addition,the author puts forward that the shared accommodation should be brought into the tax supervision and the insurance system with stronger security.
