Study On The Legal Countermeasures Of Urban Dangerous Housing Management

On march 7,2020,at the critical moment when the people of the whole country made concerted efforts to fight the "epidemic ",a hotel in quanzhou,which is a quarantine prevention and control point,collapsed because of illegal and illegal construction,resulting in casualties among medical staff and so on.Throughout recent years,Shanghai buildings collapsed,Zhejiang Fenghua buildings collapsed,and so on,dangerous housing safety accidents occur frequently.There are still some problems in the management of urban dangerous houses,such as imperfect legislation,lack of supervision,illegal construction,unauthorized decoration and rectification,which causes the management of urban dangerous houses to fall into difficulties.How to strengthen the management of dangerous houses in our country from the law has become an urgent problem to be solved.In 2015,at the third session of the Twelfth National people's Congress,Premier Li Keqiang,when deploying his annual work,put forward : " strengthen the management and transformation of dangerous houses in urban and rural areas,and bring the management and transformation of dangerous houses in scope of urbanization construction policy." China's urban crisis management work,as early as the 1970 s has begun.With the rapid development of urbanization in China in the1990 s,the management of urban dangerous houses has gradually become the focus of social attention.Due to the long-term existence of "heavy construction,less management" phenomenon,in recent years,due to the urban housing crisis caused by the second house security Accidents are endless,which seriously infringes on the safety of residents' lives and property.How to effectively manage the problem of urban housing crisis has been urgent.The effective management of urban dangerous houses is not only conducive to the continuous development of urbanization construction process in China,but also can effectively protect residents' lives and property rights and interests.How to find out the legislative defects and perfect them from the legal level district,combining with the particularity of the urban dangerous house management and the difficult situation,the author tries to analyze the methods from theory to practice through case study,literature study and field investigation.The first chapter,first,to the dangerous house,the city dangerous house,as well as the city dangerous house management concept carries on the definition;secondly,carries on the combing to the city dangerous house management basis,has carried on the analysis to the city dangerous house management legal system and the main body division.The second chapter studies the present situation and existing legal problems of the management of dangerous houses in cities.First of all,from a group of cases to analyze the current situation of the management of dangerous houses in China,so as to find out the main problems in the management of dangerous houses in China.The third chapter firstly analyzes the causes of the legal problems existing in the management of urban dangerous houses in our country,and analyzes the causes of the legal problems that cause the management of dangerous houses in our city from the aspects of system factors and theoretical factors.The fourth chapter is an analysis of the outstanding experiences of countries?regions? such as Macao,Japan,Britain and the United States in the management of dangerous houses in cities,and summarizes their experiences in the management of dangerous houses in cities valuable experience in governance for our country to learn from.The fifth chapter is aimed at the legal problems existing in the management of urban dangerous houses in our country,and combined with the author's visit investigation,excellent experience and theoretical research,from the three angles of legislation,law enforcement and justice,puts forward several ways to optimize the legal regulation of urban dangerous houses in our country.Finally,the necessity of studying the legal problems and countermeasures in the management of urban dangerous houses is analyzed.The management of urban dangerous houses is not only a social problem but also a legal problem,but also an objective analysis of the shortcomings of this paper.
