As a new form of supply public service,the government purchases public service has a long history in the western countries.This system has important practical significance for transforming government functions,improving the administrative efficiency and the quality of public service,as well as promoting the development of social organizations.At present,the government of our country is still in its infancy in purchasing public services,and local governments at all levels has begun to carry on experiments on purchasing public services.However,with the continuous promotion of practice,many legal dilemmas faced by the government in purchasing public services have also been exposed,a series of problems such as the unsound government regulations on public service procurement,the ambiguous scope,the non-standardization of procedures,and the poor relief of rights These problems all severely constrain the develop of government purchase public service in our country.It is imperative to regulate these issues by legal provisions effectively.In this paper,the author studies the current legal system of purchasing public service in our country and the practice of purchasing public services in local governments at all levels,in order to the put forward the corresponding improvement measures for improvement.The thesis is divided into five parts:The introduction part analyzes the research background,research significance,the status of domestic and foreign research,and the main contents of research and research methods as well as the innovation of this thesis.The first chapter of the thesis is an overview of legal regulation of government purchasing public service,which mainly expounds the basic connotation of government purchasing public service and distinguishes it from the concept of government procurement and privatization.In this chapter,the author analyzes the principle that the government should follow in the process of purchasing the public service and the significance of the legal regulation of the government purchases the public service in our country.It emphasizes that the government purchase public services of our country is still in the pilot phase,and it is necessary to carry out legalregulation in order to standardize the system.The second chapter of this thesis is about the problems existing in the legal regulation of purchasing public service in our country.The author analyzes the following problems in the regulation of government purchasing public service in detail such as the imperfect laws and regulations,the ambiguous scope of purchasing the service,the non-standard purchasing procedure and the poor relief of rights.The third chapter introduces the experience and enlightenment of the legal regulation of government purchasing public service in foreign country,and introduces the legal system of the public service purchased by the government in Britain,the United States and Japan in terms of legal system,purchase scope,purchase procedure,supervision and management and performance evaluation.It is a positive reference for the legal regulation of government purchase public service in our country.The fourth chapter of the thesis is about improving our government's purchasing public service.to conquer the main legal difficulties in government purchase public service in our country,we put forward some suggestions,including improving the legal system of purchasing public service,defining the scope of purchase,regulating the purchase procedure and Optimize the relief system and so on.
