At present,China has become Uganda’s largest foreign investor.As more and more Chinese companies enter Uganda,various post-investment management issues have gradually become prominent,among which labor law disputes are particularly obvious and direct.Labor law disputes often occur in all social labor relations,and are unavoidable.It is a labor dispute between employees and employers due to various conflicts of interest.But now,the labor relations between Chinese enterprises and Uganda’s local employees are tense,and labor legal disputes account for a large proportion of various legal disputes of Chinese enterprises,which seriously restricts the healthy development of Chinese enterprises in Uganda and even Africa.China’s national image has brought some negative effects.The labor law disputes of Chinese enterprises in Uganda are mainly include seven types: employment discrimination disputes,contract disputes,wage disputes,unequal treatment disputes,violations of workers’ rest rights,security compensation disputes,and illegal dismissal disputes.Some Chinese companies do not understand Uganda’s labor legal system,the implementation of labor standards is not in place.They lack awareness of the prevention of labor legal risks,and they have insufficient understanding of Uganda’s trade union organization and functions.The absence of the Chinese government’s supervision system for Uganda’s Chinese companies has led to a weak awareness of social responsibility of overseas companies,as well as a wide gap in cultural customs between my country and Uganda.There are also certain obstacles in language communication,which are the main reasons for labor law disputes.Uganda’s labor legal system is quite different from China.Uganda’s labor law takes British law as its origin,tends to protect the rights and interests of local workers,strictly regulates the import of foreign labor services,and the labor law resolution mechanism is cumbersome and complicated for Chinese companies.Therefore,the Chinese government and enterprises should jointly build a Uganda labor law dispute prevention and response system to help Chinese companies achieve healthy and stable development,which also has certain practical significance for promoting China-Uganda friendly cooperation. |
