On January 1,2020,the newly revised "Land Management Law" was formally implemented.This revision is mainly carried out from three aspects:land acquisition,rural homestead management system reform and collective business land market access.It is not only related to the effective use and protection of land resources,but also to protect the existing farmers' property rights.By promoting the reform of the rural homestead system,more rural land will be released.Therefore,it is necessary to promote the reform of the housing site system by establishing a perfect compensation mechanismThis article attempts to explore the relevant legal system for rural homestead withdrawal compensation,to provide farmers with certain economic compensation and social security for voluntary withdrawal from the homestead,and to promote the optimal allocation of rural land resources.The first chapter mainly introduces the background of researching the compensation of homestead withdrawal,and introduces the relevant research theories of homesteads by different scholars at home and abroadThe second chapter introduces the homestead system,the definition of the right to use homestead and the historical development of the homestead system in China,which provides a theoretical basis for constructing the exit compensation mechanismThe third chapter is to analyze the compensation model and exit problems used in the current exit of homesteads in different regions.First,it introduces the current implementation of withdrawal compensation,analyzes the contradictory problems in compensation,and clarifies that the existing legal system and compensation model cannot meet the demand for homestead withdrawal.Therefore,it is necessary to further improve the existing homestead exit system.The fourth chapter introduces the typical incentive mechanism model of homestead withdrawal in Zhejiang,Tianjin and Chongqing,and summarizes the experience of rural land consolidation in Taiwan,Japan and GermanyThe fifth chapter is to improve the specific countermeasures and suggestions of the rural homestead exit compensation system,analyze the specific principles,participants,compensation standards and compensation methods for exit compensation,improve the security system after farmers exit,and improve the relevant supporting policies for homestead evaluation Measures to establish a compensation system for rural housing sites that are“in line with national conditions".
