With the rise of the European Enlightenment Movement,the idea of humanization,mitigation and socialization of penalty began to emerge and develop,and the non-imprisonment penalty execution method for the purpose of socialization and differentiation of penalty gradually appeared on the historical stage.Judging from the long history of the development and change of the execution system of human penalty,the execution of imprisonment penalty and the execution of non-imprisonment penalty are consistent with each other in concept and goal,and they complement each other and are inseparable All constitute a modern system of the execution of criminal penalties,reflecting the modern criminal justice system of equal punishment,equal protection and individual distinction.In the middle and late 1960 s,the United States first proposed community correction as a way of execution of penalty,which coincided with the rapid development of its community autonomy process.As a non-custodial penalty execution system,community correction has a natural flexibility which is completely different from the prison penalty rigidity,and can help criminals to integrate into society and repair social cracks.Since 2003,China has made outstanding achievements in community correction.As one of the first pilot cities in Shandong Province,Qingdao has been carrying out community correction work in individual districts since 2004.After more than a decade of practice and exploration in Qingdao,community correction has gradually entered the track of standardization and institutionalization.In recent years,community correction institutions at all levels in Qingdao have been focusing on the goal of promoting the smooth return of community correction objects to society,and have adopted the working concept of attaching equal importance to both supervision and Education In order to maintain social peace and stability,community correction work has been actively carried out around the establishment of rules and regulations,standardization of law enforcement,construction of working teams and correction centers,education management and law enforcement supervision.At the same time as the rapiddevelopment of community corrections in Qingdao,it also revealed a series of problems,such as legislation lagging,weakening the seriousness of law enforcement,personnel and responsibilities and tasks do not match,information-based supervision mode is not rich enough,the implementation of the temporary out-of-prison enforcement system is difficult,and the coordination between the judicial departments is not smooth.As the community correction work in Qingdao started almost the same time as the national pilot project,the problems in Qingdao reflect the common problems of community correction in China.Therefore,by summing up the practical experience of community correction in Qingdao,this paper examines the outstanding problems Some concrete suggestions are put forward,such as perfecting the legal system construction of community correction,strengthening the ranks of full-time personnel and social workers,enriching the information-based supervision mode of community correction,standardizing the execution system of temporary release from prison,and establishing the coordination and Cooperation Mechanism of judicial departments I hope to explore the feasibility of improving the operation of China's community correction system.
