Many problems are recognized when the development of the environment forces people to pay attention,which is a common thing in history,and this is the case of the protection of privacy.In our country,privacy protection is mainly concentrated in the civil field,and it is still in its infancy.With the development of information technology and privacy infringement issues in the network environment,people began to pay attention to the new connotation and characteristics of privacy rights different from traditional privacy rights in the network environment,and began to pay attention to the corresponding protection issues.Moreover,the government began to use the Internet to achieve contact with various fields of society,and the right to privacy has endured more threats from public power.Public power infringe the right of privacy,which urgently requires the protection of the constitution.The rapid development of information technology has pushed the issue of the game between civil rights and government power to the forefront of the rule of law.This article mainly contains five parts.The first part is the concept of privacy in the network environment.This part mainly discusses the development process from privacy,privacy rights to network privacy rights,and the concept and characteristics of privacy rights in the network environment.The second part is the analysis of the rationale for the constitutional protection of privacy under the network environment.On the one hand,it discusses the legal basis of personal dignity,personal autonomy,and information self-determination;on the other hand,it analyzes the necessity of constitutional protection of the right to online privacy from the perspective of social reality.The third part is the status of privacy protection in the network environment.This part analyzes the current status of protection of privacy from the constitutional level,criminal law level,civil law level,administrative law level,and social operation level.The fourth part is the extraterritorial experience of the constitutional protection of privacy under the network environment.The author focuses on analyzing the constitutional protection models of the United States,Germany,and South Korea,and on this basis,puts forward inspiration for the protection of privacy in China.The fifth part is the perfect suggestion on theconstitutional protection of privacy under the network environment.It is mainly carried out from three levels: first,the constitutional status of the right to privacy must be determined,then the connection and interaction between the Constitution and other legal protection methods need to be improved,and finally,normative opinions should be put forward at the level of social operation.
