Research On The Right To Be Forgotten In The Age Of Big Data

In the era of big data,the use of information data greatly facilitates our life,but our personal information is also at a glance,but the risk of infringement of personal rights and interests is growing.On the one hand,the personal information of the information subject is widely collected and stored,which is difficult to delete;on the other hand,the personality image of the information subject is constantly developing and changing,which brings great trouble to the personal development of the information subject,hinders the development of the personality freedom,and thus leads to a lot of judicial disputes.When it is necessary to delete the information when it loses its purpose,it is necessary to give the information subject the right to delete these information to protect human rights.It is a historical necessity to introduce the right of being forgotten into China in order to protect the legitimate rights and interests of information subjects.This paper uses literature survey and comparative analysis methods,on the basis of consulting a large number of literature,and systematically studies the construction of forgotten right under the background of big data.Based on the analysis of the historical evolution,concept,nature of the right to be forgotten and its relationship with other rights in the context of big data,this paper points out that the right to be forgotten has some conflicts with freedom of speech,public interest and the development of Internet economy,and there are many applicable obstacles such as unclear relief methods On this basis,this paper makes an in-depth study of the legislation and practice of the forgotten right in the existing international society,and in view of their operation mechanism,it thinks about its reference significance to China,and makes a comprehensive discussion on the creation of the forgotten right in the following aspects: the principle of proper purpose,the principle of informed consent,the principle of information authenticity,and the improvement of the subject,object and relief method of the forgotten right.
