While big data brings convenience to human beings,the characteristics of its permanent memory make "forgetting" become the function that people yearn to realize.When people perceive that their privacy space is less and less,they gradually derive the expectation of forgetting in the network age.In this regard,the concept of right to be forgotten was originally proposed and defined by the European Union.Later by more and more developed countries learn from,absorb,gradually become the focus of attention of various countries.With more and more western countries gradually attaching importance to the right of being forgotten,it is foreseeable that in the rapid development of big data today,the legal confirmation of the right of forgotten through a right type is the only way to conform to the improvement of the socialist legal system with characteristic characteristics.The Internet is closely linked to people’s work and lives.Huge data applications affect the protection of general privacy and moral rights.Taking into account the legitimate value of the right to forget and to achieve the protection of the individual dignity of citizens,and should pay more attention to the emerging rights in the Internet era.So that the information subject in the Internet field of personal information to be more comprehensive protection.Only when people really have the right to be forgotten in the field of Internet can people be more free to express and exist with dignity.The text of this paper consists of four chapters.The first chapter expounds the historical background and development status of forgotten power system,analyzes the attitude of the right and the focus of controversy,analyzes the self-determination of personal information,and is more suitable for the protection through legislation such as personal information protection law.Chapter2 analyzes the current situation and problems of the right to be forgotten in China and whether or not to consider introducing the right to be forgotten in China.The third chapter mainly introduces a summary of the legislative process and experience that determines the right to be forgotten in countries outside the region,an analysis of the development of the protection of this right against the background of the national conditions of our country,the definition of the principle of understanding and deciding conflicts between the right to be forgotten and other rights and interests.Chapter IV puts forward legislative suggestions on the legalization of the domestic right of forgotten: first analyzed the legislative model suitable for China ’s national conditions,then analyzed and listed the elements of the protection of the forgotten right in detail,and finally put forward a number of supporting institutional measures in order to better and effectively protect citizens’ personal information.
