A Study On The Legal Guarantee Mechanism Of Financial Development Right In Minority Areas

China is a unified multi-ethnic country with a large population of ethnic minorities.China implements the system of regional ethnic autonomy in accordance with its special national conditions.For a long time,there have been great differences between the minority ethnic groups and the Han for various reasons,such as political,economic and cultural development.The economic development in the ethnic areas and the developed areas has a certain gap because the natural conditions in the ethnic areas are quite diverse,there is a general existence of a single economic structure,weak Base,closed economic ties and uneven economic development,due to various constraints,the level of economic development behind the developed areas.Since the promulgation and implementation of the Constitution in 1982,and especially the implementation of the law on regional ethnic autonomy in 1984,great progress has been made in the work of national legislation in our country,and the fundamental rights of ethnic areas have been guaranteed,including the right to economic development,the right to education and so on,but in fact,the minority areas for the financial protection of the lack of economic development lags behind the developed areas.The right to financial development in ethnic areas refers to the right of citizens in ethnic areas to participate in and enjoy the process and results of financial development under the leadership and support of the state.The most essential goal is to pursue substantive fairness,and through the analysis of the characteristics of the financial development right in ethnic areas,such as human rights,nationality,subject collectivity,and content comprehensiveness,the main contents of the right are studied,the right to security of basic financial services,the right to participate in financial development,the right to share in the fruits of financial development and the right to support financial development,this paper analyzes that the main body of the legal relationship of the financial development right in ethnic areas is the citizens of the country,ethnic areas and ethnic areas,and recognizes that the financial development right in ethnic areas plays an important role in the economic development of ethnic areas.Further,according to the current legislation and implementation of the right to financial development in ethnic minority areas in China,as well as the existing problems,this paper puts forward suggestions on how to protect the right to financial development in ethnic minority areas from the legal level,the first is to regulate theparent right of financial development in the constitution,which is the fundamental law of the country.The second is to improve the system of financial rights in ethnic areas,the third is to improve the implementation of security mechanisms,establish a multi-level system of financial institutions,encourage financial institutions in ethnic areas to innovate in financial services,guide the healthy development of financial norms;Fourthly,the government provides policy guidelines and institutional support for the realization of the right to financial development in ethnic minority areas,while the central bank is responsible for formulating and implementing financial-related national policies,to guarantee the financial service and implement financial supervision in ethnic areas;to construct the inclusive financial system in ethnic areas so as to realize the protection of the rights and interests of financial consumers;Seventh,the innovative relief mechanism of the right to financial development in ethnic areas is proposed,which ensures the right to financial development.
