At present,China’s higher education is developing rapidly,and the requirements for academic quality are constantly increasing,coupled with the promotion of modern science and technology.The resulting disputes for the cancellation of degree are also increasing.Therefore,improving the degree revocation system guarantees the rights and interests of students,regulates the behavior of universities,gives full play to the goals of colleges and universities to cultivate talents,and ensures students to abide by academic standards.Most of the previous studies focused on disputes over degree-granting rights.There are few studies on disputes over degree-revocation rights,but it is precisely the deprivation and revocation of degrees after they are acquired,which will cause a significant loss of student rights.This article explores another way,selects ten typical cases,and conducts academic discussions on this issue through empirical research methods,in order to better solve the shortcomings of the current degree revocation system.China’s degree revocation cases can be divided into two categories:academic and non-academic.In general,it has the characteristics of multiple reasons for revocation,time concentration,and different judicial decisions.In the disputes of degree revocation,along with different causes and different understanding of legal norms,and personal level of judges,even completely different judgments in the same case.This reflects that the current degree revocation system in China has several flaws.as following:lack of systematic degree revocation regulations,different standards for degree revocation in universities,unsound revocation procedures,and imperfect relief mechanisms.Therefore,it is urgent to perfect the degree revocation system.First of all,we should improve it legislatively,specifically define the "fraudulent and fraudulent" behavior,and comprehensively set up procedural rules for degree revocation.Secondly,colleges and universities should be constrained by academic reasons and evidence relevance when exercising the right of degree revocation,following the principles of rationality,due process,trust protection,and proportionality.Finally,the student’ s rights relief mechanism should be implemented to form a diversified relief mechanism and work together to implement the protection of student rights.
