Study On The Administrative Accountability System In China

The effective control of the expanding administrative power is the key to the realization of modern democracy.In order to prevent and punish the administrative misconduct,the administrative accountability system comes into being,which can prevent the abuse of administrative power by supervising and investigating the illegal behavior of the administrative subject.The system of administrative accountability is of great significance to the investigation of the illegal and dereliction of duty of administrative officials,the protection of people’s sovereignty,the construction of a government under the rule of law and a responsible government,etc.,to perfect the theoretical research of administrative accountability system and promote its development in the field of practice has become an important measure to promote the socialist rule of law,and also plays an irreplaceable role in promoting China’s democratic process.In China,the administrative accountability system started in 2003,the "SARS" event has knocked open the door of the administrative accountability system.In the past 20 years,the relevant issues have been the focus of research in the academic circle,and the system has made important achievements in our country.But on the whole,China’s administrative accountability system is still at the initial stage,and many aspects of the system design and actual operation are not perfect,the increasingly complex social environment and frequent social problems call for the emergence of a more complete system.Based on the background of China’s administrative accountability system,this paper analyzes the significance of improving the administrative accountability system.This paper reviews the research status of administrative accountability system at home and abroad,and clarifies several basic problems of administrative accountability system,including the definition of related concepts and the elaboration of its constituent elements.On this basis,this paper expounds the theoretical basis of the existence and development of administrative accountability system,namely:The theory of People’s sovereignty,the theory of responsible government the theory of government by law and the theory of the unity of power and responsibility.This paper summarizes the achievements of China’s administrative accountability system,and further through the practice reflected in a variety of problems,combing the current development of China’s administrative accountability system.On the whole,the difficulties of the system are mainly manifested in the following aspects:the imperfection of the legislation on administrative accountability,the unscientific definition of the constituent elements,the unstandardized accountability procedure and the unsound supporting mechanism.At the same time,this paper compares and analyzes the advantages and disadvantages of the administrative accountability system in Britain,the United States and Germany,and sums up the enlightenment of the three countries’ administrative accountability system to China,and combined with the experience of foreign system design,put forward relevant suggestions to improve China’s administrative accountability system,it mainly includes perfecting the legal system of administrative accountability,perfecting the constituent elements of administrative accountability system,standardizing the procedure of administrative accountability and perfecting the supporting mechanism of administrative accountability system,etc.,with a view to promote the improvement and development of China’s administrative accountability system to contribute.
