Study On The Protection Of Medical Rights And Interests Of Criminals In Henan Province

The human rights of prisoners are of universal concern to the international community,and the right to health is the basic guarantee of the human rights of prisoners in prison.China attaches great importance to the protection of prisoners’ right to health,and has established a relatively complete policy design and implementation guarantee mechanism for prisoners’ right to health.However,because China’s medical security system is based on the system of the general population,there is a lack of special design for criminals and other special groups,which makes Prison Criminals independent from the medical security system of the general population in terms of medical insurance,medical assistance and medical welfare.With the development of society,the medical rights and interests of prisoners in prison have made great progress.However,the contradiction between the mode of medical security of prisoners and the development of social medical security has impacted the medical rights and interests of prisoners in prison,thus affecting the safety and stability of prison.This paper attempts to discuss the practical problems and reform direction of the protection of the medical rights and interests of criminals.On the basis of summarizing the research results of domestic and foreign scholars on the protection of the medical rights and interests of criminals,using the methods of field investigation and case analysis,according to the actual situation of Henan Province,the research idea is to analyze the problems of the protection of the medical rights and interests of criminals in the current context,and then put forward the countermeasures.Through the analysis of the rights and interests of the criminals,this paper discusses how the prison,as the executing organ of the penalty,gives consideration to the protection of the medical rights and interests of the criminals.Based on the actual situation of the prison system in Henan Province,this paper analyzes the current situation of the protection of the medical rights and interests of criminals and the expenditure,analyzes the drawbacks of the "public fee" medical treatment of criminals and the problems existing in the medical protection of criminals in our province at this stage,and on this basis,clarifies the necessity of the medical reform of criminals.This paper puts forward some countermeasures,including paying more attention to the protection of the medical rights and interests of Prison Criminals,establishing a medical rights and interests protection system based on the payment of prison insurance premiums,establishing and improving the medical rights and interests protection system of Prison Criminals,and providing operational suggestions for the basic medical insurance of urban and rural residents,so as to promote the reform of the medical rights and interests protection system and mechanism of prisoners and improve the medical treatment of prison Under the premise of protecting the medical rights and interests of criminals,we should effectively reduce the burden of prison medical expenses,reduce the pressure of going out to see a doctor,resolve the contradictions between the police and the prisoners,provide strong support for the reform of criminals’ peace of mind,create a fair and just social environment,and put the medical security work of criminals in our province on the track of legalization and standardization.
