Through the methods of literature research,comparative analysis and interdisciplinary research,this paper seeks the legal basis for exercising the universal jurisdiction of piracy on the basis of combining the relevant provisions of the universal jurisdiction of the international conventions and customary international law.In the light of the relevant provisions on piracy in the United Nations Convention on the Law of the Sea and the basic elements involved in the concept of universal jurisdiction,the definition of universal jurisdiction for piracy is summarized and the characteristics of universal jurisdiction for piracy are explored in this paper on the basis of comparative analysis of other international crimes.Knowing the fact that the general jurisdiction of piracy in The United Nations Convention on the Law of the Sea is not perfect,this paper,using the relevant rules of the United Nations Convention on the Law of the Sea as a prerequisite,explores the exercise of the general jurisdiction of piracy around several basic issues related to the universal jurisdiction system in order to prevent its abuse.Based on the practical dilemma of the common jurisdiction of the crime of piracy,this paper also analyzes the dilemma of law-appropriateness,the dilemma of trial mechanism selection and the dilemma of pirate arrest and explores the countermeasures to break through these dilemmas in the last chapter of the article.This paper is divided into four chapters:The first chapter is an overview of the universal jurisdiction of piracy,analyzing the definition and characteristics of the universal jurisdiction of piracy crime,and introducing the international law basis concerning the universal jurisdiction of piracy crime;the second chapter explores the regulation to which the general jurisdiction of piracy should be subject based on the United Nations Convention on the Law of the Sea and the system of universal jurisdiction;the third chapter analyzes the exercise the dilemma of the crime of piracy in reality;the fourth chapter proposes solutions to the problems analyzed in the third chapter.
