| Due to the special nature of the shipping industry,seafarers require special protection as they are facing risks in their daily life working onboard the ships.International Labour Organization has adopted the Maritime Labour Convention in 2006 to protect the seafarers’rights as a single coherent instrument and it has entered into force in 2016.Myanmar has ratified the Maritime Labour Convention in 2016 with accession and implemented it in Myanmar Legal Regime.As Myanmar is a developing country,the seafarer is one of the important contributing elements not only to trading but also to the country’s major income.It is always needed to provide more protection when it comes to seafarers for protecting the fundamental rights and promoting the professions.Among the other protections,social security protection is one of the fundamental factors to decent work and the least aware by most of the seafarers in Myanmar.The research aims to study International Maritime Regulations for seafarer social security and implementation by Myanmar Legal Regime for seafarer social security using the comparative method to find out the weak points of implementation in the national legal regime and make suggestions on improving the current legal regime.Firstly,the research introduces the seafarer social security with background information,research objectives,research outlines and methods for the research.Secondly,the research reviews the basic concepts of seafarer social security on seafarers,social security and governing law for seafarer social security.Third,the research studies the international legal framework for seafarer social security and sets out the standards for the requirements for implementation by ratifying states of the Maritime Labour Convention.Also,the research studies the duties and responsibilities of various actors for seafarer social security required by international maritime regulations.For the fourth step,the research studies implementation by Myanmar in the current national legal regime for seafarer social security to find out weak points by comparing the requirements and standards of international regulations.Last but not least,the suggestions on improving the existing national legal regime for seafarer social security will be stated considering favor protections for seafarers and situations in Myanmar.Finally,the research is concluded to provide suggestions on favorable protections for seafarers and recommended to prepare more protection for seafarers’ social security. |
