The 2006 Maritime Labour Convention came into effect on August 20,2013,and subsequent amendments to 2014.China actually assumed its obligations in November2015.At the same time,the Convention was amended in 2016 The case also officially entered into force for China on January 8,2019.It not only integrates dozens of standard that is used by the international labour organization since the 1920 s,but also updates the standard,make it adapt the modern life,therefore is called “the fourth pillar” of international maritime management system.In addition to the macro impact on international maritime management,the 2006 Maritime Labour Convention’s inheritance and innovation of the international protection system for seafarers’ labor rights and interests is more remarkable.In order to study the influence of the 2006 Maritime Labour Convention on international maritime labour relations and the opportunities and challenges it brings to China’s maritime labour law.This paper makes a vertical and horizontal comparison between the 2006 maritime labor convention and the international convention on seafarers’ right to work initiated by the international labor organization over the past 100 years,analyzes the evolution of the international seafarers’ right to work protection system in the past century from the background,skills and specific contents of the convention,so as to demonstrate the innovative,scientific and reasonable content and structure of the 2006 Maritime Labour Convention.On this basis,the author further interprets the three amendments to the 2006 Maritime Labour Convention,and analyzes the positive role played by China in the amendment process of the 2006 Maritime Labour Convention.Finally,based on China’s national conditions,in view of China’s problems of inadequate protection of seafarers’ labor rights and interests in the concrete implementation of the 2006 Maritime Labour Convention and the imperfect implementation mechanism of the relevant maritime labor protection,corresponding implementation suggestions are proposed from two aspects,namely,legislation and law enforcement.It provides a new way of thinking for perfecting the protection system of seafarers’ rights and interests in China.
