| Since the rise of online live broadcasting in 2016,the industry of online live broadcasting has developed rapidly.Various kinds of live broadcasting have penetrated into many aspects of people's life,forming a new media with traffic that can not be underestimated,but with few legal regulations.By defining the types of live network,this paper expounds the characteristics of copyright of live network.Compared with the various forms of works stipulated in the copyright law,the online live broadcast shall be classified into audio-visual works created by the method similar to film production,and the scope of copyright protection of the online live broadcast shall be clarified.On this basis,this paper combs the judicial practice of the copyright protection of live network at home and abroad,and sums up two outstanding problems of the copyright protection of live network,that is,how to protect the copyright of live network and how to regulate the copyright infringement of the stolen works in the process of live network.Based on the experience of the system design of "patent alliance" in the United States,it is proposed that the live broadcast platform should take the lead in purchasing the authorization from the game companies,the Chinese composer Association and other copyright subjects to allow their live broadcast rooms to use their works legally.For those who embezzle works,the live broadcasting regulatory department can start to establish a blacklist system for content creation and set up corresponding professional prohibition regulations.By improving the punishment of infringement,we can purify the live network environment and encourage the creation of content culture. |
