| Water administrative law enforcement is an important part of the rule of law and the rule of water in China.It is also an important prerequisite to ensure the stable and healthy development of water conservancy.At present,the water administrative law enforcement work of grass-roots River Basin institutions in China is still not optimistic.Based on the current situation of grass-roots water administrative law enforcement work,this paper comprehensively uses the literature analysis method and investigation research method to fully study the theory of government by law and the theory of administrative balance.Taking the practice of water administrative law enforcement of Dongying Yellow River Bureau as an example,it carries out the research on water administrative law enforcement of grass-roots River Basin institutions.With the increasing emphasis on water resources and environment in China,the administrative law enforcement system has been continuously improved,and the current situation of water administrative law enforcement of grass-roots River Basin institutions has been effectively improved.The management of law enforcement team should be innovated,full-time water administration supervision team should be set up,law enforcement personnel should be reasonably allocated,education and training should be routine;law enforcement equipment should be scientific and technological,and efforts should be made to strengthen law enforcement while effectively improving law enforcement efficiency;supervision methods should be diversified,various information should be released in a timely and effective manner,daily supervision should be carried out throughout the work,and public interest litigation should play an important role.Based on the research on the water administrative law enforcement work of Dongying Yellow River Bureau,the existing problems are summarized as follows: the legal system of river basin management is not perfect,some rules and normative documents are in cross conflict,the construction of legal system is lagging behind,and the operation of high-level laws and regulations is not strong;the authority of water administrative law enforcement at the grass-roots level is not enough;the system of water administrative law enforcement is chaotic,which is in line with the local water administrative department The division of law enforcement powers is not clear,the functions of internal institutions are overlapping,and the law enforcement procedures are not standardized;the publicity of water laws and regulations has little effect,the citizens’ awareness of water law is not strong,and the implementation of administrative penalties is difficult;the grass-roots law enforcement capacity is insufficient,the number and level of law enforcement personnel are limited,and the allocation of lawenforcement equipment is not perfect.The reasons for these problems are: the state and local governments do not pay enough attention to the water administrative law enforcement work of the grass-roots River Basin institutions;the administrative management system is not perfect;the implementation of water laws and regulations is not in place;the grass-roots water administrative law enforcement conditions are limited,the quality of personnel is uneven,and the funding is insufficient;the law enforcement supervision system and mechanism is not perfect.Based on the analysis of the existing problems and causes,this paper proposes to strengthen the legal construction of river basin management,improve and modify the relevant laws and regulations,clarify the power of law enforcement,increase the punishment of water administrative law enforcement,seriously implement the river chief system,increase the publicity of water administrative law enforcement at the grass-roots level,improve the ability of law enforcement at the grass-roots level,strengthen the training of laws and regulations and professional knowledge,improve the quality of law enforcement personnel,and carry out law enforcement letters In order to promote the development of water administrative law enforcement,we should strengthen the supervision and inspection of water administrative law enforcement,implement the construction of three systems and actively accept public supervision,and innovate five measures of law enforcement mode and means. |
