On The Legalization Of Service And Management For Foreigners

The administration of foreigners in China by public security organization refers to the general term for the exercise of state sovereignty and police functions and powers,and the implementation of administrative and criminal jurisdiction activities in accordance with the law for related affairs involving foreigners,foreign organizations,foreign institutions,foreign countries and international organizations.With the development of modern police work and the transformation of police functions to service-oriented,the public security organs pay more attention to the humanization,socialization and legalization of the management of foreigners in China.Service and management for foreigners is one of the important contents of grass-roots public security law enforcement,and it is also an important work for public security organization to maintain national sovereignty,security and entry-exit order.In recent years,the promulgation and improvement of a series of foreign-related laws and regulations has provided the legal basis for the public security organizations ' service and management of foreigners,guaranteed the legitimate rights and interests of foreigners in China,and played an important role in regulating the order of exit and entry and safeguarding national security.However,with the increase of the number of foreigners coming to China,the situation is becoming more and more complex.In addition,the relevant laws of our country established relatively late.In the process of the public security organizations ' service and management of foreigners,there are some problems,such as the lack of comprehensive legal provisions,the degree of standardization of law enforcement,etc.Starting from the characteristics of the service management of the public security organizations to foreigners,this paper tends to start with the law enforcement practice of the public security organizations,contact with relevant theoretical knowledge,analyze the problems faced by the service management of foreigners under the background of the rule of law,and explore the solutions from the aspects of improving the legal provisions,refining the guidance norms,standardizing the law enforcement behavior,strengthening the publicity of the rule of law,and strengthening the supervision of law enforcement.
