As the starting of the process of handling civil cases,civil service largely determines the efficiency and quality of the overall handling of cases.As the key link of litigation procedure,civil service is as important as civil trial in a certain range.However,in the context that the litigation entity is far more important than the litigation procedure,civil service is hard to pay attention to.It is undeniable that there has been a positive trend in the legislation of civil service.The 2012 version of the civil procedure law and the 2015 version of the judicial interpretation of civil litigation have supplemented the service system,in which the relevant service methods,service places and other aspects have been elaborated in more detail and expanded.In addition,the high-tech service means have also been appropriate Supplement.In 2017,the Supreme People's Court issued the notice of several opinions on Further Strengthening the civil service work,which further stipulated the confirmation of the service address of the parties and seeking the cooperation of the grass-roots organizations for service,etc.,which alleviated the pressure of delivery difficulties to a certain extent.However,with the gradual effectiveness of the work of ruling the country according to law,eradicating crime and so on,the main role of the court in resolving social conflicts has become increasingly prominent,and the number of cases that follow has doubled year by year,resulting in a large number of service work has become the bottleneck in the process of handling Court cases.As a judge assistant of the grass-roots court,the author will analyze the operation of the current civil litigation service system,analyze the shortcomings of various service methods and explore the causes,compare the foreign service system to take its advantages,so as to put forward measures to improve the domestic civil service system,and think about the the way out of the dilemma of civil service.The main body of this paper consists of the following four parts:The first part is the basic theory of civil service system in China,including the legal concept of civil service,the value and function of civil service,and the general situation of civil service in China.The second part is the empirical analysis of civil service system in China.This part is mainly about the author's own work experience in the grass-roots court,elaborating the applicable degree and efficiency of various modes of service in judicial practice,analyzing the shortcomings of various modes of service and exploring their causes.The third part is the comparison of the civil service system of the main countries.Due to the huge differences in economic development and social culture between different countries and regions,there will be differences in civil service.They will formulate a relatively suitable service system according to their own national conditions,which is worth learning from in China.The author tries to find out the strengths of other countries and consider the possibility of their strengths in China through analysis.The fourth part is the way out of the dilemma of civil service.This part explores the way out of the dilemma of civil service from three aspects: updating the concept of civil service,improving the relevant laws and means of civil service,and optimizing the supporting measures of civil service system.
