Research On The Legal Issues Of Ship Building Under The Strategy Of Civil-military Integration

In January 2017,the Ministry of Industry and Information Technology,together with National Development and Reform Commission,the Ministry of Finance,SASTIND and other six ministries and commissions issued the Action plan for deepening structural adjustment,accelerating transformation and upgrading of shipbuilding industry(2016-2020)proposing to promote multi-element civil military integration in the shipbuilding industry,promote civil military collaborative innovation,and further strengthen civil military technology integration in the shipbuilding industry to transfer,promote the sharing of military and civilian resources.China’s shipbuilding industry is facing the situation of low innovation ability,poor level of high-tech shipbuilding technology and low orders for high value-added shipbuilding.Promoting the integrated development of civil and military in ship building is conducive to promoting the technological innovation and upgrading of ship building,accelerating the industrial upgrading of ship,building,and optimizing the coordinated development of national defense security and economic construction.This paper is divided into four chapters to explore the legal issues related to ship building under the integration of military and civil.The first chapter studies the basic theory of ship building under the integration of military and civil.Starting from the concept and characteristics of ship building under the integration of military and civil,it defines the research scope of legal issues in the field of ship building under the integration of military and civil.By analyzing the legal basis of ship building under the integration of military and civil,it combs the relevant norms of ship building,and focuses on the research theme of this paper.The second chapter is about the legal research on the market access of ship building under the military civilian integration.It analyzes the current legal system of the market access of ship building in China from the aspects of the management subject,conditions and supervision of the market access of ship building under the military civilian integration.The third chapter studies the legal issues related to the rights and obligations of ship building technology under the military civil integration.From the perspective of technological achievements transformation,it uses the theory of property rights incentive and the theory of interest balance to elaborate the identification of the right subject,the authentication of the right object and the distribution of the specific content of the technical rights and obligations of ship building technology under the military civil integration.The fourth chapter focuses on the improvement of the law of civil military integration in the field of ship building in China,focusing on the deficiencies of the rights in the relevant laws of market access and technical rights of ship building under civil military integration,and puts forward the corresponding specific improvement measures,and the relevant ideas of the law on the construction of supporting support system to promote the national defense construction and national economy in the field of ship building in China rational allocation and coordinated development of economy.
