Study On The Improvement Of The Ability Of Health Administrative Law Enforcement In Henan Province

With the rapid development and promotion of the rule of law economy and society in our country,the rule of law as a basic concept and principle of governing the country must keep pace with the times,constantly strengthen and comprehensively promote the scientific law enforcement,guarantee the fairness and justice of the law,and promote the whole people to abide by the law.Based on this,as a government organ,it is not only necessary to act according to law,but also more important to restrict and regulate its political behavior and power according to law,which puts forward higher political requirements for the ability of health administrative departments and organs to administer according to law.In the past 40 years of reform and opening up in China,under the deepening market-oriented environment,the health administrative department has always been the core department to maintain and standardize the health market order.In recent years,with the diversification and complexity of the operation mode of the health market main body and its law enforcement departments,new types of illegal behaviors emerge in endlessly,which seriously damages the social market economic environment of fair competition and the legitimate rights and interests of the people.The frequent occurrence of law enforcement incidents reveals that some health administrative law enforcement departments are lax and out of place The problem of misplaced law enforcement or offside law enforcement is serious,which leads to the increasing risk of health administrative law enforcement.Under the severe situation of continuous integration of health administrative departments and continuous reform and improvement of law enforcement and supervision system,some health administrative law enforcement departments still face many problems,such as imperfect law enforcement and supervision system,unsmooth operation,low efficiency of law enforcement,and high risk of law enforcement.Based on the statistical analysis of the current situation of health administrative law enforcement in 2018 and the evaluation results of some closed cases of health administrative punishment in recent years,this paper analyzes the deficiencies in the capacity of health administrative law enforcement in Henan Province,and puts forward solutions to provide theoretical reference for further improving the capacity of health administrative law enforcement in Henan Province.This paper is divided into seven chapters.Firstly,it discusses the research background,makes clear the overall research ideas and research methods;The second chapter briefly describes the theoretical tools used in this study;the third chapter describes the core concepts and classifications of health administrative law enforcement and health administrative punishment;the fourth chapter focuses on the current situation of health administrative law enforcement in Henan Province by combining a large number of data;the fifth chapter combs the shortcomings in the capacity of health administrative law enforcement in Henan Province;the sixth chapter describes the river In the seventh chapter,based on the analysis of the problems causes,and carefully put forward countermeasures.Based on the analysis of the current situation of resource allocation,personnel allocation and main work indicators of health administrative law enforcement in 2018 in Henan Province,combined with the results of file review in recent years,this paper finds that the shortcomings of health administrative law enforcement in Henan Province mainly lie in the decision-making power of health administrative law enforcement program,the deployment power of health administrative law enforcement resources,the understanding power of health laws and regulations,and the information of health laws and regulations In terms of the communication power,it is manifested in the lack of effective legal support,the high risk of administrative law enforcement,the imbalance of resource allocation,the lack of personnel allocation,the unreasonable distribution of key points of law enforcement,and the prominent problems in law enforcement and case handling.These problems are mainly due to the inadequate legal protection,heavy law enforcement tasks,low sense of identity,the traditional case handling mode can not meet the needs of the new era,the lack of attention of local governments,insufficient business training,and inadequate publicity of health laws and regulations.It is suggested that the ability of health administrative law enforcement in Henan Province should be improved by speeding up the construction of legal system,carrying out new means of law enforcement,reasonably distributing the key points of law enforcement,increasing the attention of the government,strengthening the construction of talent echelon,strengthening education and training,establishing performance evaluation system,unblocking channels,and strengthening the publicity of legal system.
