Investigation And Research On Juveni Le Injury Cases Handled By Procuratorial Organs In H City Of A Province

With the development of our country’s social economy,the occurrence of crime shows a worsening trend.Minors account for a considerable proportion of victims in criminal cases.Minors are vulnerable due to their physical and psychological immaturity.Minors are the future of the motherland and the hope of the nation.The actual situation of minors being killed should be given sufficient attention by the society.On the basis of earnestly implementing the laws and regulations of the Party and the state concerning the protection of the legitimate rights and interests of minors,the procuratorial organs of the city of H have carried out a series of explorations within the scope of their duties,and have achieved certain results,fully demonstrating the great potential of the procuratorial organs to take the initiative in preventing the victimization of minors.There has to be something new.From January 2016 to June 2019,the procuratorial organs of the city of H received a total of 77 cases in which the victims were minors.From the perspective of the type of case,it is mainly divided into crimes that infringe on the rights of the person,crimes that infringe on property rights,crimes that infringe on the order of social management,etc..The number of cases of intentional killing,rape,and indecent assault is on the rise,and the social reasons behind them are worth pondering.The regional characteristics of juvenile homicide cases are affected by the judicial reform factors of the procuratorial organs,such as the "centralized jurisdiction" system;From the characteristics of time and space,there is a certain regularity.Judging from the characteristics of the victimization of minors,the professional distribution of the injurers is diversified,mainly concentrated on farmers and unemployed people.In terms of age,the number of people in their youth is the highest.In the case of minor killings in City H,criminal suspects who are also minors also account for a certain proportion.The means of committing crimes is mainly based on individual crimes.For example,in the case of sexual assault,the perpetrators create unnecessary individual contact,give special treatment,special relationships,and break physical boundaries.Criminal means tend to be intelligent and covert.The proportion of the injurer as an acquaintance is relatively high,and the "family" relationship in the sexual assault case has become a cover.The injurer has repeatedly’ committed long-term violations through inducement.From the analysis of the causes of the victimization of minors,there are several aspects such as their own factors,family factors,school factors,social factors,and legal factors.Children from poor,foreign or left-behind families who are neglected by their parents to care for and communicate with minors are easy to take advantage of by criminals.The faculty and staff use their work to facilitate the infringement of students,mainly reflected in two aspects:violence and sexual abuse.The procuratorial organs of the city of H have made some useful explorations in handling the cases of minors being killed.First,they have strengthened the construction of organizations and set up juvenile procuratorial case teams,"protection of girls ’lectures" and "minors’ legal education bases";The second is to actively protect the legitimate rights and interests of minors,heal psychological wounds as much as possible,and specifically eliminate their desire for revenge,to prevent minor victims from becoming victims of the "evil reversal" problem;The third is the judicial protection of minors,which not only pays attention to effective substantive rights protection,but also insists on procedural rights protection.However,it also faces some difficulties in handling cases,such as evidence issues,qualitative issues,value conflicts,and the interface between public,prosecution,and law.The fourth part of the paper discusses the direction of the prosecution office handling the cases of minors being killed,mainly divided into the exercise of state parental rights,improvement of related systems and multiple measures to strengthen the prevention of minors being killed.To build judicial and social defense lines and set up a coordinated juvenile protection system,we can give minors a safe environment for growth.This paper puts forward some countermeasures to prevent minors from being killed in order to benefit the relevant work of procuratorial organs and to promote the protection of minors in the future.
