Disability is a phenomenon that exists objectively in the biological world.Looking back at the history of human development,the perception of people with disabilities from the initial cruel rejection to the final equality and integration has marked an improvement in the social status of persons with disabilities.Protecting the rights and interests of the disabled is to respect human beings.As the core and foundation of the right to education,compulsory education,whether it is a disabled child or a healthy child,should have equal rights to prevent discrimination based on mental or physical defects.Despite efforts,China has achieved certain developments in the right to education for children with disabilities,but there are still some shortcomings in the legal protection of our country.Therefore,the article is written around the related issues of legal protection of the right to compulsory education for children with disabilities,by analyzing and summarizing their own research results.The first chapter,the paper first puts forward four related concepts of“compulsory education”,“disability”,“children with disabilities” and “the right to education of children with disabilities”.This leads to the basic meaning of the article“The right to education of disabled children in compulsory education stage”.Secondly,it puts forward five basic characteristics of compulsory education,namely compulsory,free,basic,democratic and secular.Thirdly,on the basis of the basic connotation of the right to education of disabled children,the educational methods,the particularity and main content of children with disabilities are proposed.The basic characteristics of the right to education of disabled children are: the particularity of the subject,The uniqueness of the content and the particularity of the state's obligations.Finally,it discusses the significance of the three children's right to education in the compulsory education stage: the basic embodiment of political civilization,the inevitable requirement of social justice and the fundamental way to realize the value of children with disabilities.In the second chapter,the system elaborates the development of the right to education for children with disabilities.This chapter mainly divides the development process into three periods,namely,the three periods of germination,establishment and guarantee.Combining history,comparing the development achievements before and after the First World War in the nascent period;analyzing the changes after the promulgation of the Universal Declaration of Human Rights and the Declaration on the Rights of the Child during the establishment period;mainly discussing the International Human Rights Convention and the Rights of the Child during the safeguard period Two iconic documents of the Convention are analysed.In the third chapter,we first discuss the status quo of China's guarantee of compulsory education for disabled children,mainly from the aspects of legislation,administration and justice.Secondly,from these three aspects,it analyzes the dilemma faced by China's security process.In the fourth chapter,we start with the safeguard measures of the United States,Japan and Britain.From the historical discussion to the status quo,this chapter concludes with a summary of the enlightenment of the legal protection of the right to education of disabled children in the United States,Japan and Britain to China.In the fifth chapter,six suggestions are proposed mainly for the above contents:improving education legislation,improving legal effectiveness;clarifying government responsibility,strengthening administrative law enforcement;improving the system of compulsory education supervision for disabled children;establishing parental(custodial)disabled children to participate in supervision Mechanisms;policies and systems for the transfer of vocational education and legal remedies.
