Research On The Tort Liability Of The Application Of Face Recognition Technology In The Field Of High-speed Railway

At present,with the rapid development of cutting-edge technology based on big data,face recognition technology is born and developed.The large-scale application of face recognition in the field of high-speed rail improves people’s travel efficiency and facilitates people’s life.At the same time,the infringement related problems are also highlighted.This paper studies the tort liability of face recognition technology in the application of high-speed rail by using the ideas of finding,raising,analyzing and solving problems.This paper is divided into three parts from the structure,the first part is to ask questions,starting from the basic theory of face recognition technology application and its advantages and problems in the field of high-speed rail,this part mainly focuses on the basic characteristics and application of face recognition.In the second part,based on the problems existing in the application of face recognition technology in high-speed rail,the reasons are analyzed.First of all,the theory of tort liability is regarded as the basis and starting point of the problem analysis.Secondly,it analyzes the specific causes of the infringement of face recognition technology,which is based on the four elements of legislation,administration,system and self-discipline.The third part constructs the prevention system for the tort liability of face recognition.Following the above analysis,it mainly focuses on four aspects: accelerating legislation,establishing administrative supervision,establishing compulsory insurance system and improving industry self-discipline.The author tries to draw lessons from foreign regulatory methods,combined with China’s national conditions,put forward new ideas to solve the problem of infringement,and build a complete path to prevent the infringement of face recognition,which has certain innovative significance.
